Therefore, in consideration that said Board of Public Works proceed <br />to improvesaid street as proposed in said resolution, and for the further <br />purpose of saving time and expense„ we, the undersigned, do hereby waive all <br />obections and defense to any defect in said proceedings, and to any violation in <br />procedure for the improvement of said street as fixed by Section 6710 of Burnts <br />Revised Statutues of 1914. We further waive any right to object to the form of <br />said resolution. We further waive any and all objections to the fact that no <br />advertisement for the hearing was publishedas required by law, and that no notice <br />were mailed to the owners of property and that no hearing was held by said Board. <br />We further waive any and all objections to the requirements that <br />in grading said street that a pavement shalo also be laid thereon, and do hereby <br />give our .consent that said irmproveraent be made without such pavement and -waive <br />any and all objections thereto. <br />We also consent that said Board shall proceed to let the contract <br />f or doing said -work in the fol low ing manner; <br />That they shall notify by mail responsible contractors in the City <br />of South Bend, Indiana of said work to be done under said resolution, and that <br />they shall receive bids from said contractors for the doing of said work, and they <br />shall let the contract for the doing of said work to the lowest responsible <br />bidder. And we waive any objection to the action of said Board in letting said <br />contract in a form and manner other than provided by said section 8710: <br />And we further consent that the cost of doing said work shall be. <br />assessedloagainst the different parcels of real estate owned by us as provided <br />by Sections 8710,8711,8714,8715,8716,8717 8718 of Burns's Revised Statutes 'of <br />1914. <br />And -ve further agree that notice given us by mail shall be suf- <br />ficient notice of -the hearing upon the assessment made for said improvement. <br />Given under our hands on the day of tear first above mentioned. <br />WHITCOMB & KELLER <br />HERbAN I. BOARD,OF PUBLIC WORKS <br />80UTH BEND, INDIANA. <br />WHEREAS, the Board of Public Works of the City of South Bend, <br />Indiana., did, on the 11th. day of April 1917 adopt a preliminary resolution for <br />the improvement of Ewing Avenue Arom Miami Street to west line of Oak Park <br />4th. Addition, in the City of South Bend, Indianal by the grading the street from <br />property line to property lines, curbing the roadway with cement curb and con- <br />structing cement sidewalk on both sides of said street. All as shown on the <br />plans, and in accordance with profiles, detail drawings and specifications on <br />file in the offices of the Board of Public Forks. <br />And Whereas, we, the undersigned, are the only persons owing <br />property on said street to be improved, and that we alone are affected in any <br />way by said proposed improvements. That we are the sole owners of the seaarate <br />parcels of land bordering upon said street proposed to be improved: <br />i <br />Therefore, in consideration that said Bard of Public Works pro- <br />ceed to imr__ rove said street as proposed in said resolution, and for the further d <br />purpose of saving time and expense, we, the undersigned,, do hereby waive all <br />objections and defense to any defect in said proceedings, and to any violation <br />in procedure for the improvement of said street as fixed by Section 8710 of Burns, <br />Revised Statutes of 1914.
