SIDEWALK IMPROVE18NT RESOLUTION NO 509.1917.
<br />✓ Resolved by tie Boardof Public Works of the` City of South Bend,
<br />St. Joseph. County, State of Indian,, That it . 1s desired and deemed necessary to improve
<br />Ewing Avenue from Miami Street to the west line of. Oak Park Fourth Addition as follows,
<br />to -wit: -
<br />By grading said Avenue from property line to property line to the
<br />established grade, curbing t-_e roadway with cement ourb and constructing ceement didewalk
<br />on both sides of said Ewing Avenue. All as shown on the plans, and in accordance with
<br />the prof iles , deta it drawings and spec if icat ions on f ile in the Off ice 'of the Department
<br />of Pub 1 is Works of the City of South Bend, Indiana, in accordance with the profile,
<br />details, drawings and specifications on file in the office of 'the Department of Public
<br />Works of said City; and such improvement is now ordered.
<br />The cost of said improvement, in -lading the cost of street and alley
<br />intersections, shall be assessed upon the real estate abutting or. said Ewing Avenue
<br />all according to the _met`.od and manner provided for in an Act of the General Assembly of
<br />the State of Indiana, _entitled " An Act Concerning Uunicipa.l Corporations, approved
<br />Uareh 6,1905, and in accordance with and pursuant to the provisions of all amendatory
<br />and supplemental acts thereto, passed by the General Assembly of the State of Indiana.
<br />Assessments, if deferred, are to be paid in ten equal anraal ' installments, with interest
<br />at the rate of Six per , c nt oer a,nnum. A bond or. bowls shall be issued to the contractor
<br />in payment of such work, unless the property owners pay `said `assessment before , sa.id bond
<br />or bonds are issued. Under no circumstances shah. t!e City of South Bend, or he held,
<br />resnor�s ible for wrju sum or gums, due frog w p= opoty owner or ow.rers for said work or
<br />for the collection of the sa-e, or for the payment of any bond or bonds, certificate
<br />or certificates, issued to said contractor in payment for such ,,,uercect for -;uch money --
<br />as shall have been received by the City from the assessm nts for such improvement, or such
<br />moneys as said City is by said above entitled Act required to pay. All proceedings , had,
<br />and work done in the making of said improvement, assessment of property, collection
<br />of assessments and issuance of bonds therefor, shall be as provided for in said above
<br />entitled Act and amtendrients thereto.
<br />Be :It ,Further Resolved, that the Board of Public Works has approved
<br />of a wliver signed by property owners waiving all notice of advertising mnd hearing
<br />on s a. id resolution and Board hereby fixes the 17th: d .y of April 191'7 at 10: 00 A.M. -for
<br />receiving of bids. Letters to be sent to all contractors about such bids.

<br />f WHEREAS, the Beagid of Public Works of the City of South Bengt,
<br />Indiana, did, on the llth. day pf April 1917 Donald Street from Miami Street to Eadt line
<br />of High Street to the City of South Bend, Indiana, by grading the street from property
<br />line to property line, curbing the roadway with cement curb andsconstructing cement
<br />sidewalk on both s idas of said street. All as shown 4h the plans, and in accordance with
<br />profiles, detail drawiNgs and spec if icat ions " on file in the Office of the Department
<br />of Public Works.
<br />.And Yaereas, we, the undersigred, are the only persons owning
<br />property on said str'eet to be improved, and that we alone are affected in any way by
<br />said proposed improvements, That we are the sole owners of the separate parcels of land
<br />bordering upon said street proposed to be improved.
