Wood <br />her husband, of'St. Joseph County, State of Indiana, give, grant and convey to the <br />City of South Bend, Indiana for the sum of One ($1.00� Dollar and other valuable <br />considerations, the right, privilege and easement of building in the City of South <br />Bend, Indiana a trunk sewer over the real estate of the grantor herein described, <br />which trunk sewer shall be ccnstructed over and along the following line: - <br />Beginning at a point on the east side of the St. Joseph River located <br />south 51°44jeast a distance of 530.8 feet from a 1-8 stone boca.ted 1320 feet more <br />or less east of the north west corner of section 35 Township 138 N. range 2 East, <br />thence south 700 40' west 675.5 feet; thence to the left 46 0 on a curve of 50 <br />foot radius a distance of 40.2 feet; thence to the right 28*0' on a 16°0' curve <br />a d-istance of 200 feet; thence to the left 46*40' on a 6°40' curve a distance of <br />700 feet; thence on a tangent to the 6*40' curve south 38*0' west a distance of <br />175.5 feet; thence to the right 52*0' on a curve of 50 foot radius a distance of <br />48.2 feet; thence west a distance of 199 feet to a point 1346 feet south of the <br />north line of section 34 Twwnship 38 N. Range 2 East and 76.5 feet°east of the cents <br />of Portage Avenue; thence west to the easterly line of Pottage Avenue. <br />And the said City of South Bend and its contractor shall have the <br />right and privilege of going upon said land and using the same for a space of ' twenty <br />five (25) feet eaeb side of the above described line for the purpose of con- <br />structing such trunk sewer, which right or easement shall be temporary and shall <br />exist only until such sewer is constructed; but the City shall have a right and <br />easement to go upon said land to repair the sewer and keep it in good working <br />order de_�long as it desires to maintain a sewer bullet over said land, and.along <br />said line as above described. <br />The above grant or easement is made for the further consideration that <br />the grantors here are the owners of the lands lying at the western -most terminus <br />of the above described line on which a sewer is to be constructed, and that the <br />construction of such trunk sewer will be of great value and benefit to the grantors <br />and to their real estate, in that it will afford a proper sewer outlet for their <br />said land; and this grant and easement is made upon the csnsddera,tion and condition <br />that said city will, during the year 1917, cause such sewer to -be -constructed, all <br />of which shall be done in good and workmanlike manner, and in the f#mm and manner <br />that such sewers are usuallycenstructed in said City. <br />.JN WITNESS WHEREOF, they have hereunto set their hands this 6th. day <br />of April ,1917. <br />STATE OF INDIANA ) SS <br />ST.
