NOW, THEREFORE,, BE IT RESOLVED that as to said assessment in the sum of <br />one Hundred Twentynine and 661100 ($129.66) Dollars against said Railway Company <br />as an abutting property owner, that ten bonds be issued in accordance with the <br />powers vested in said City by the provisions. of, said Acts, the foirst of which <br />bonds shall Ve in the gum of Thirteen and 56/100 ($13.56) Dollars, due May 7th.. <br />1917, and the balance of said bonds shall be due and payable respectively one <br />(1), two (2) Three .(3), Four (4), five (5), six (6). Seven (7), eight (8)1, <br />and nine (9) years after the said first day of June,1917 and each of said 'bonds, <br />except said first bond, shall be in the sum of Twelve and 90/100 ($12.90) Dollars <br />and all of said bonds shall be numbered consecutively from one to ten inclusive. <br />BE IT FURTHER RESOLVED, that as to said assessment made against said <br />railway Company underits franchise in the -sum of Twenty-seven Thousand thirty- <br />five and 83/100 ($27,035.83) Dollars that ten bonds be issued in accordance with <br />the powers vested in said City by virtue of the provisions of said Act 9 the first <br />of which bonds shall be in the sum of Twenty-seven hundred four and 33f1a0 <br />($2764.33) Dollars, dueMay 7,1917, and the balance of said bonds shall be due <br />and payable respectively one (1) tiro(2), three (3),' four (4), five (5), six (6), <br />seven (7), eight (8) and nine (91, years after the said first; -day of June,1917. <br />and each of said bonds, except said first bond, shall be in the sum of twenty- <br />seven hundred three and 50/100 ($2703.50) Dollars,.�and,all of said bonds shall be <br />numbered' consecutively from one to ten inclusive.. Thai' each of the bonds mentioned <br />in this resolution shall be payable by the City 'of -'South Bend to w Bea,rer",,thereof <br />at the Treasurer's office out of funds actually paid in, or collected by -:it from, <br />the Chicago, South Bend,& Northern Indiana Railway Company, upon each of the <br />accounts respectively on account of said improvement and the agreement of .said <br />Company to pay for the same'. , <br />Said bonds shall be payable in lawful money of the United State, with- <br />out relief from valuation of anpraisement laws and attorneys fees. `,Each of said <br />bonds shall bear interest at the rate of Six percent Gaza (6%) per ann.um from the <br />first day of June,1917, payable semi- annually on presentation and surrender of <br />of the coupons attached to said bonds as they severally' mature. Said. bonds shall <br />have the same priority over other liens as have assessments for other street <br />improvements and shall be a first lien on all the ,property, assets and franchises--, <br />of said Railway Company in the manner and to the extent provided by lair. <br />Adopted by the City of South Bend , Indiana, by and through its <br />Board of Public Works this 3rd. day of march 1917. <br />E. k.
