Wood appeared before the Board in regard <br />s' t o hav ing a trunk sewer ys�em placed in the Samuel Good Addition. This muter was <br />referred to the City -Engineer for a report by 4: 30 P.M. Saturday March 10th. ,1917. <br />Mr. Horace L. Greene appeared before the Board and requested permission <br />for the Lexingtoft Tea. IZQom proprietors to place a sign on post in front of J. M. S. <br />v Bldg, on sidewalk advertising Tea rooms located on 8th. floor of said building. This <br />matter was referred to the Building Commissioner. <br />PW of Del C._Leerfs 3rd. Addition presented by Del. C. Leer was <br />approved by the Board. <br />Mr. Isaac Van Trump appeared before -the Board, in regard to inspection <br />of Asphalt pavement on Eddy Street and Mishawaka Avenue. The Board informed Mr <br />`Van Trump that bids would be received March 20th. ,1917 at 10: 00 A.M. for inspection <br />of asphalt is pavement in this C ityl this - year. <br />The Board instructed the Clerk to notify different Engineers of the <br />bids to be received March 20th. ,1917 at 10: 00 A.M for inspect ion of a�talt ie pavements <br />min the City this year. - <br />Permission granted to the Central Union:Telephone Company to set poles <br />and anchors in the City on various streets, and alleys.. <br />The Board ordered that the case of S. D. Moran placing a showcase on <br />public property referred to them by the Building Department, be referred to the City <br />attorney for enforcement of the law regarding the same. <br />The following resolution was approved by the Board. and referred to the <br />City Controller. <br />RESOLUTION OF THE B O,,_RD OF PUBLIC WORDS OF THE CITY OF SOUTH BEND <br />IND IIM . <br />WHEREAS, the City of Sonth Bend, Indiana, by and through its Board of <br />Public Works, heretofore, by improvement Resolution No. 415, caused Michigan Street <br />, from the North line of La Salle Avenue to the south line of South Street in the City <br />to be improved by paving the same; And, <br />WHEREAS, the Chicago, South Bend & Northern Indiana Railway Company <br />occupies a portion of sadd street for the operation of its electric railway, and by the t <br />and cond it ions of its franchise is required to pave a portion of said street; And, <br />WHEREAS, Said Railway Company is also -the owner of real estate abutting <br />upon said improvement: And, <br />WHEREAS, the portion of said street required to be paved by said Railway <br />Company was paved by the Western C onstruct ionC ompany, a corporation organized under the <br />State of Indiaaa, as contractor for such work, and same was completed by it as such <br />contractor and accepted by th City of South Bend on the 6th. day of February,1917; And, <br />WHEREAS, on the 3rd. day of March 1917, said Railway Company executed and <br />filed with the said City of South Bend, its stipulation and agreement waiving objections <br />on account of any illegality or irregularity in the proceedings had for such improvement <br />of said street and requested the Gity to issue bonds -to procure. funds with which to pay <br />that portion of the cost of said improvement chargeable against said Railway Company <br />both as n abutting property owner and under its franchise obligations in the manner <br />provided by an °Act ,ent itledv­" An Act Concerning kunic ipal Corporations, " approved <br />March 6, 1905, and all amendatory and supplemental acts thereto; And, <br />-WHEREAS.—It-appears that the amount chargeable to and payable by said <br />Railway Company as an abutting property owner by reason of said improvement amounts to <br />the sum of One hundred Twenty-nine and 661100 ($129.66) Dollars, and under the terms <br />of its franchise by oreason of said improvement, the sum of Twenty-seven Thousand Thirty <br />five and 8�J00 (27,035.8) Dollsrs, with interest on each of said sums from the 6th. <br />day of Fbbruary, 1917, to the first day of June ,1917. <br />
