(b) After the elapse of thirty (30) days from the due date, the Union has given ten (10) days <br />written Notice by certified mail with a copy to The Group and any appropriate prime <br />contractor, of such delinquency, In which notice the Union states that the employer Is <br />delinquent and failure to make payment within ten (10) days of receipt of such notice will <br />result in a strike; and <br />(c) There is no genuine dispute that there is a delinquency. <br />ARTICLE 10 <br />BOND FOR WAGES, FRINGE BENEFITS, <br />SCRC AND INDUSTRY FUND <br />The Union may at its discretion require those Employers who have not maintained an established <br />office In the jurisdiction of the Teamsters Local No. 142 for five (5) years or more, or an Employer who <br />has a past record of delinquencies of payment, to procure, pay the premium for, and deliver to the Union, <br />a bond written by a responsible Surety Company. Such bond shall, at the discretion of the Union, be in a <br />penal sum up to One Hundred Thousand Dollars ($100,000) to insure proper payment of the Employer's <br />Teamsters 142's wages, fringe benefits, BCRC, and industry fund in accordance with this Agreement. If <br />the Employer falls to provide a bond in accordance with this Article, the Union, after giving the Employer <br />ten (10) business days written notice, shall have the right to strike such Employer. All bonds shall be <br />made payable to Teamsters Local No. 142. <br />ARTICLE 11 <br />HOURLY WAGE RATES AND JOB CLASSIFICATIONS <br />A. HOURLY WAGE RATES AND JOB CLASSIFICATION FOR ALL COVERED WORK <br />Section 1. Effective June 1, 2016, and continuing in full force and effect through May 31, 2017 <br />the following Hourly Rates of Pay shall prevail for the Job Classification listed below: <br />Straight Time <br />Time and <br />Double Time <br />Friinge <br />Hourly Rate <br />One -Half <br />Rate <br />Benefits <br />Group I - 2 or 3 Axle Trucks <br />$32.29 <br />$48.44 <br />$64.58 <br />$24.58 <br />Group 2 - 4 Axle Trucks <br />$32.49 <br />$48.74 <br />$64.98 <br />$24.58 <br />Group 3 - 5 Axle Trucks <br />$32.69 <br />$49.04 <br />$65.38 <br />$24.58 <br />Group 4 - 6 Axle Trucks <br />$32.89 <br />$49.34 <br />$66,78 <br />$24.58 <br />Group 5 - The rates for this group are Group 4 rates plus $0.35 per axle for each axle over six (6).
