ARTICLE 2 <br />WORK COVERAGE <br />This Agreement shall cover Heavy and Highway and all other Construction work in Lake. Porter. <br />Calumet City, IL and all other Counties wherein: Local No. 142 has jurisdiction. <br />All work covered by the terms of this Agreement shall be performed exclusively by those <br />classifications of employees specified in the Agreement. The Employer further agrees that no Trucks or <br />other equipment specified in the Agreement shall be used or operated unless a Driver or Operator <br />covered by the terms of this Agreement Is driving same, except for Pickup Trucks used by Foremen or <br />other Supervisory Personnel for transportation purposes only, This shall be strictly enforced by the <br />Company and the Union. No one shall haul material' except employees covered by this Agreement, <br />It is also agreed that Drivers shall not perform major mechanical work on trucks. <br />ARTICLE 3 <br />UNION SECURITY <br />Section 1. Additional Employees: When the Employer needs addiflonal employees, it shall <br />give the Union as much nofice as reasonably possible to provide a list of qualified applicants. It is <br />understood that the Employer shall not submit such a request "at the last minute" unless it is impossible <br />to do otherwise, This request shall be made either In writing or verbally to one of the Union designated <br />individuals responsible for providing the list of qualified applicants. In the event that it is not practicable to <br />provide written notice, the Employer shall provide a written confirmation of its verbal request within seven <br />(7) days of the verbal request. Both the written and verbal requests shall identify the specific job <br />classification(s) to be filled, the certjfication�s) required, the expected hours of the job and the expected <br />length of the job. It is understood however, that the hours and length of time is only an estimate and not a <br />guarantee. <br />Once the Union receives the inifial request (whether in writi�ng or verbally), it shall provide to the <br />Employer a list of up to ten (10) qualified drivers to perform the specific job classification (s) to be filled <br />with such individual(s) having the certifications which the Employer seeks. The Union shall provide this <br />list to the Employer within forty-eight (48) hours of the request, excluding Saturdays, Sundays and <br />holidays. When the Employers request does not permit the above identified forth -eight (48) hour time <br />period (including the exclusion of Saturdays, Sundays and hoiidays), to occur, the Union shall provide the <br />list of qualified drivers within twenty-four (24) hours with the Employer being required to provide written <br />documentation (within seven (7) days) clemonstrabng that it had no control over such a late request being <br />made. Similady, when an, Employer requests the list of qualified drivers then fails to hire anyone for the <br />requested posibon, the Union may request the Employer to provide written documentation that the order <br />for the driver(s) has been cancelled by the customer. If requested, the Employer shall provide its <br />documentation within seven (7) days of the Union's request. While the Union agrees that these two <br />instances shall not be grievable, the parties agree that the Union may request such information for <br />purposes of provided same for purposes of establishing any abuse of this provision which information can <br />then be provided to the Group�'s Collective Bargaining Chairman. <br />In the event that the Employer does not choose to hire any individuals identified in the Union's <br />provided list, it may request one or more additional lists of up to ten (10) drivers. If the Employer still does <br />not choose to hire an individual(s) from these lists, then it shall hire individual(s) who has (have) the <br />required certifications and has had experience performing the sought after job classification (or its <br />equivalent as identified in the job classification groupings identified in this contract). In the event the <br />Employer has chosen to hire someone whose name has not been provided by the Union's list(s), the <br />Union may request the Employer to provide wriften proof that the hired individual has met the above <br />Idenfified requirements, Any individual hired under the terms of this last paragraph may be required by <br />the Union to enroll in, and complete training classes conducted by the Teamster Local No, 142 Training <br />and Apprenticeship Trust Fund at no cost to the Employer in order to bring the skill level of the new <br />employee to the level of a competent Construction Driver, Such new employees shall start such training <br />when the next training classes begin, which shall be within six (6) months after the new employee is <br />hired. The new employee shall be considered a probationaryltemporary Driver until such time as he has <br />
