0 3 <br />RESOLUTION NO. 803 <br />SOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />CONFIRMING RESOLUTION NO. 800, REDECLARING <br />TJ�KmSOUTH BEND CENTRAL DEVELOPMENT AREA TO BE BLIGHTED <br />Y FQ9 1 ?URPOSES OF COMPLIANCE WITH THE TAX REFORM ACT OF 19$6 <br />-EREAS, the South Bend Redevelopment Commission <br />ion), governing body of the City of South Bend Department of <br />R e4elopment (Department), on April 24, 1987, adopted Resolution No. <br />800, redeclaring the South Bend Central Development Area to be <br />blighted for purposes of compliance with the Tax Reform Act of 1986 <br />(Declaratory Resolution); and <br />WHEREAS, the Declaratory Resolution found and determined <br />that an area within the City of South Bend, Indiana (City) designated <br />by the Commission as the South Bend Central Development Area (Area) <br />continues to be blighted within the meaning of I.C. 36 -7 -14 (Act); <br />and <br />WHEREAS, the Declaratory Resolution further found and <br />determined that there is a substantial presence in the Area of <br />excessive vacant land on which structures were located, abandoned or <br />vacant buildings, old buildings, excessive vacancies, substandard <br />structures, and delinquency in payment of real property taxes; and <br />WHEREAS, the Declaratory Resolution readopted the South Bend <br />Central Development Area Development Plan (Development Plan); and <br />WHEREAS, certain Findings of Fact have been presented to the <br />Commission which concern the location, physical condition of the <br />structures, land use, environmental influences and other economic . <br />conditions of the Area and the Commission now desires to adopt and <br />confirm the Findings of Fact for the area; and <br />WHEREAS, the Area Plan Commission of St. Joseph County, <br />Indiana (Plan Commission) at its regular meeting on the 19th day of <br />May, 1987, adopted and approved its Resolution No-92 determining that <br />the Declaratory Resolution and the Development Plan for the area <br />conform to the plan of development for the City and approving, <br />ratifying and confirming the Development Plan; and <br />WHEREAS, the Common Council of the City of South Bend, <br />Indiana, at its meeting on the 26th day of May, 1987 adopted, <br />Resolution No. 1511 -87, which approved the resolution of the Plan <br />Commission, found and determined that the Area continues to be <br />blighted, and adopted the Development Plan for the Area; and <br />WHEREAS, the Commission caused to be published a Notice of <br />Public Hearing concerning the Area on the 5th day of June, 1987, and <br />filed by hand delivery a copy of that notice in the offices of the <br />Plan Commission, the Board of Zoning Appeals, the Board of Public <br />Works, the Park Board and the Building Commissioner; and <br />
