<br />RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT
<br />COMMISSION CONFIRMING RESOLUTION NO. 834, EXPANDING THE
<br />Mph BOUNDARIES OF THE SOUTH BEND CENTRAL DEVELOPMENT AREA,
<br />REDECLARING THE AREA AS EXPANDED TO BE BLIGHTED,EXPANDING
<br />THE ALLOCATION AREA FOR PURPOSES OF TAX INCREMENTAL
<br />FINANCING, AMENDING THE DEVELOPMENT PLAN AND REAPPROVING
<br />THE DEVELOPMENT PLAN AS AMENDED
<br />WHEREAS, the City of South Bend Redevelopment Commission
<br />( "Commission "), governing body of the City of South Bend Department
<br />of Redevelopment ( "Department ") on March 11, 1988, adopted
<br />Resolution No. 834 (the "Declaratory Resolution ") expanding the
<br />boundaries of the South Bend Central Development Area, redeclaring
<br />the area as expanded to be blighted, expanding the allocation area
<br />for purposes of tax incremental financing, amending the Development
<br />Plan and reapproving the Development Plan as amended; and
<br />f WHEREAS, the Declaratory Resolution found and determined
<br />that an area within the City of South Bend, Indiana ( "City ")
<br />designated by the Commission as the South Bend Central Development
<br />Area, as expanded ( "Area "), is and continues to be blighted within
<br />the meaning of I.C. 36 -7 -14 ( "Act "); and
<br />WHEREAS, the Declaratory Resolution further found and
<br />determined that there is a substantial presence in the Area of
<br />excessive vacant land on which structures were located, abandoned
<br />or vacant buildings, old buildings, excessive vacancies,
<br />substandard structures, and delinquency in payment of real property
<br />taxes; and
<br />WHEREAS, the Declaratory Resolution readopted the South
<br />Bend Central Development Area Development Plan, as thereby amended
<br />( "Development Plan ") ; and
<br />WHEREAS, certain Findings of Fact have been presented to
<br />the Commission which concern the location, physical condition of
<br />the structures, land use, environmental influences and other
<br />economic conditions of the Area and the Commission now desires to
<br />adopt and confirm the Findings of Fact for the Area; and
<br />WHEREAS, the Area Plan Commission of St. Joseph County,
<br />Indiana ( "Plan Commission ") at its regular meeting on the 15th day
<br />of March, 1988, adopted and approved its Resolution No. 97
<br />determining that the Declaratory Resolution and the Development
<br />Plan, as amended, for the Area conform to the plan of development
<br />for the City and approving, ratifying and confirming the
<br />Development Plan, as amended; and
<br />WHEREAS, the Common Council of the City of South Bend,
<br />Indiana, at its meeting on the 28th day of March, 1988, adopted
<br />Resolution No. 1598 -88, which approved the resolution of the Plan
<br />Commission, found and determined that the Area is and continues to
<br />be blighted, and adopted the Development Plan, as amended, for the
<br />Area; and
<br />WHEREAS, the Commission caused to be published a Notice of
<br />Public Hearing concerning the Area to be held on the 15th day of
<br />April, 1988, and filed by hand delivery a copy of that notice in
<br />the offices of the Plan Commission, the Board of Zoning Appeals,
<br />the Board of Public Works, the Park Board and the Building
<br />Commissioner; and
<br />WHEREAS, at the hearing held by the Commission on the 15th
<br />day of April, 1988, at 10:00 o'clock a.m., Eastern Standard Time,
<br />AnK at 1200 Councy -City Building, South Bend, Indiana, the Commission
<br />heard all persons interested in the proceedings and received
<br />written remonstrances and objections that had been filed, and
<br />considered those remonstrances and objections, if any, and such
<br />other evidence presented.
