the Declarant, assigns, or employees, attempt to mow, prune, <br />irrigate, scythe or otherwise or artificially maintain the natural <br />systems found in such Conservation Easement without prior written <br />approval of the Committee. <br />7.3.3 All the provisions of these easement reservations, including the <br />benefits and burdens, run with the land and are binding upon and <br />shall inure to the benefit of the successors, successors in interest, <br />assigns, heirs, tenants, and personal representatives of the <br />Owners and Occupants from time to time of Blackthorn. <br />7.3.4 The rule of strict construction does not apply to the easement <br />reservations herein above set forth. Such reservations shall be <br />given a reasonable construction so that the intention of the <br />Declarant as set forth in Article II of the Declaration is carried out. <br />7.4 Installation and Maintenance Responsibilities of Landscape Areas. In <br />furtherance of the purpose of these Declarations as stated in Article II <br />herein, the following establishes installation and maintenance <br />responsibilities of the Common Areas, the Landscape Easement Areas, <br />Open Space and Parking Landscape Areas, and Conservation Easement <br />Areas. <br />7.4.1 Common Areas. All those areas shown as "Common Areas" on <br />Exhibit "D" initially will be landscaped and certain decorative <br />Improvements constructed thereon by the Association. However, <br />the Owner of developed lots may supplement these plantings on <br />the Common Areas adjacent to their site. After initial installation, <br />the landscaping shall be maintained by the Association in <br />accordance with the provisions of this Declaration and the <br />Guidelines. The lawn in the Common Areas between the outer - <br />edge of the curb and the right -of -way line of all Public Rights of <br />Way, when adjacent to a developed Blackthorn Site, will be <br />maintained by the Owner of said Site. <br />7.4.2 Landscape Easement Areas. All those areas shown as <br />"Landscape Easement Areas" on Exhibit "E" initially will be <br />landscaped and certain decorative Improvements constructed <br />thereon by Owner in accordance with the plans and specifications <br />submitted to and approved by the Committee. After initial <br />installation the landscaping in such areas shall be maintained by <br />the Owner until such landscaping has remained healthy for a <br />minimum of twelve (12) consecutive calendar months.
