311 <br />1?. the grade pf Rush Street, where the same intersects the tracks of the <br />New York Central Railroad Company, shall be raised three and eight -tenths (3.8) feet <br />above the top of the highest rail of s €i id tracks as. now maintained, and the tracks <br />of said company across said street shall be raised 'to conform to the grade. of said <br />street when changed as prrvlded- herein.' And the grade of .said street south of the <br />southerly rail shall be andescending grade. of five (5) feet to ,ach _one hundred., (100) feet <br />until it intersects the present street gradet and the grade of said street north of the <br />northerly rail -shall be a straight line from said rail until it intersects the grads <br />of Sample Street as established in No..16 above. And the grade of Rush Street_ north of <br />Sample Street shall be changed so as to conform .to the grade of. ,Sam�Ple. Street as fixed <br />in No. 16 above, and descending at the rate of Five (5_) feet to each,one hundred (100) <br />feet until it intersects the present street grade. And the grade of the first alley <br />east of Rush Street and intersecting Sample Street, 811a11 be -changed so as to conform <br />with,the grade of Sample Street as herein f ixed and djescond i3ig at the rate of f`ivei <br />(5) feet to each one hundred feet until it intersects the present alley grade. And the <br />grade .of Angle Street, which intersects both Sample Street and Rush Streets shall be <br />changed so that it <br />spa 11, (111) conform to the Sampia Street grade- and thence dedeend <br />at the rats of Sic (6) feet -to each one hundred (100) feet until it intersects the <br />present streat grade.and (2) it shall be changed so as to conform to the Rush Street <br />grade and thence- descend at the rate of Six (6) feet to -each hues hundred (100) feet <br />until it intersects the present street grade. And the grade of the first alley south <br />of Sample Street, which intersects Rush. Street on the west side, shall be changed so as to <br />conform to the grade of Rush Street as established at No. 17 above and thence descend <br />at the rate of five (5) feet to each. one hundred (100) feet until it intersects the <br />present alley grade. <br />18. The grade of Ohio Street, where the same intersects the.tracks of <br />New YorkCentral Railroad Company shall be raised two and six -tenths (2.6) feet above <br />the top of the highest, rail as now maintained, and the tracks of said company across <br />said street shall be raised to c onf orm to the grader of said street when altered as <br />pr ov ided herein., And the grade of said street from the westerly and easterly rails <br />shall be descending grades of five (5) feet to each one ,hundred (100) feet until <br />said grades intersect the present street grades. <br />19. The grade of iiarieptta Street, where the -same intersects the tracks <br />of the New York Central Railroad Company, shall be raised two and three -tenths (2.3), <br />to e t above the top of the highest rail of said tracks as now maintained,, and the tracks <br />of saki company across said street shall be raised to conform to the grade of said <br />street when changed as provided herein. And the grade of said street from the northerly <br />and southerlyrails of said railroad shall be descending grades of five (5) feet to each <br />one hundred (100) feet until said grades -intersect-the present street grades. Add the <br />grade of tha alley adjacent to the south side of the right of way- of said railroad - <br />company and intersecting lobar ietta Street, shall be changed so as to c onfopm, to the grade <br />of Marietta Street, and then descend at ,the rate of five (5) feet to each one hundred <br />(100) feet until it intersects the present alley grade; and the grade of the alley :south <br />of Ohio Street and intersecting the west side of Marietta Street shall, be changed so <br />as to c onf orm to the grade of Mar iitta Street and then descend at .the rate of five . (5) <br />feet to each one hundred (100) feet until it intersects the present alley grade.. <br />20. The grade of High Street, where the same intersects the tracks of <br />the New York Central Ra ilr oad Company, shall be raised seven -tenths (.%) f a foot <br />above the top of the highest rail of said tracks as now ma inta ined, and the tracks of <br />said company across said street shall be raised to conform to the -grade of said street <br />wher. changed as provided herein. And the grades of sadd streets. from the northerly and <br />s outher ly rails of said rdilr oad shall be descending grades at the rate. of five (5 ) <br />feet to each one hundred (100) feet until they intersect the present street grade, <br />21. The grade of Arnold Street where the same intersects the tracks of <br />the New .,ork Central Raiload Company shall be raised four and eight -tenths (4.8)' feet <br />above the top of the highest rail of said tracks as now maintained; and the grade of <br />Arnold Street, where the same intersects the tracks of the Grand Trunk Western Railway <br />Company shall be raised f-ive and six -tenths (5.6) feet above the top of the. highest <br />rail of said tracks as now ma inta ined; and the grade of Arnold Street where the same <br />intersects the tracks of the New York Central Railroad Company, formerly the Chicago, <br />Indiana & Southern Railroad Company, shall be raised not to exceed six (6) feet above <br />the top of the highest rail -of said trucks as now maintained; and the grade of said street, <br />where it intersects the switch track of the New York Central Railroad Company leading <br />into the Oliver Chilled Plow Works shall be raised not to exceed six (6) feet above the <br />top of the highest rail of said switch track as now maintained, and the tracks of all <br />said companies .across said streets at said point shall be raised to conform to -the <br />grade of said street at said several points when changed as provided herein... The grade of <br />said street north from the northerly rail of the tracks of the New vork Central Railroad <br />Company shall be a descending grade of five (5) feet to each one hundred (100) feet until <br />it intersects the present street grade, and the grade of said street south shall be a <br />descending grade from the southerly rail of the last above mentioned railroad, to a point <br />mielwag between said rail and the northerly rail of the rdilroa.d of the Grand,trunk <br />Western Railway Company, which point shall be three and thre&Mtenths (3.3) feet higher <br />than the present high rail of the New York Central Railroad; and the grade from said last <br />,above mentioned point shall be ail ascending grade to the northerly rail of the railroad <br />of the Grand -+runk Western Railway Company, and from the southerly rail of the last <br />above mentioned railway company, the grade of said street, shall be a straight line to the <br />
