The Board adopted modified Resolution No. 2 in present formwith certain <br />exceptions and the City Attorney was directed to modify said resolution in <br />accordance with the instructions�of the Board. This mg.tter deferred until <br />5:00 R. U. this 27th. day of November 1916. , <br />The following contract was signed by the Board and referred to the <br />Common Counc it f or rat if ica.t ion,. <br />WHEREAS, the. City of South Bend desires to cruse to be established <br />end installed and placed in operation a lighting system, and <br />MEREAS, it is desired on the part .of the said City of South Bend for <br />economic reasons, to light said territory by the system known as the Five Lamp <br />Post Lighting System,." and <br />WHEREAS, the Indiana and Michigan Electric Company is a. public <br />utility, owning and operating a system for the manufacture, distribution end sale <br />of electricial current for heat, , light and pourer purposes in the City- of South Bend, <br />andos the only utility so engaged therein and desires to sell elect-ricial current <br />to said City and to establish an ornamental lighting system in the territory here- <br />inafter defined.. <br />NOW, THEREFORE, in consideration of the covenants herein made by and <br />between each of the .parties hereto, it is agreed by and between the said City of <br />South Bend, party of the first part, and the Indiana and Michigan Electric Company, <br />party of the second part, that the said party of the second part shall use that part <br />of Jts cyst,em no�jv instm.1led `4 the territory hereina"'ter defined and property <br />equipped, the same as h-reinafter described, in the lighting of said streets and <br />shall extend an ornamental lighting system in, along and upon the following streets, <br />nd within the following territory in the City of South Bend, County of St. <br />Hnon Main Street,from La, Salle Avenue to Wayne Street; upon Vicl igan <br />Street from La Salle Avenue to Monroe Street; upon Mayne Street from }Jain Street <br />to St. Joseiah.Street; upon Jefferson Boulevard from the alley Between Lafayette <br />ar.d Ms,i; Streets east to St. Joseph Street; Washin.gtoa Street from the alley between <br />Lafayette and Main StreeitsEast td Michigan Street; Colfax Avenue from Main Stree o <br />to mielligax itrelt ; and two -lamp poster sba1L be• installed on the north side of <br />La Salle °Street on Ma- in Streets and also on MichiganStreet. <br />It is further agreed that the party of the second part shall remove <br />the present are lamps now in use in such a part of said territory above described <br />as rapidly as is consistent with the progress .of the work and replace the same with <br />said ornamental lamps.' Each and all of said lamp posts of said system shall be <br />Installed at the locations approximately as designated upon a blue print -attached <br />hereto, marked "Exhibit A." and igadk'a part hereof. The top lamp in each :post shall <br />be a one hundred (100) candle power lamp, or its equivalent and the other lamps on <br />each post shall be a sixty candle .power tungsten lamp, or their equivalent; and said <br />top lamp shall burn each and ever night during the year, 3from dusk to dawn, or. <br />approximately four thousand (4000� hours of service and the four lower Lamps on -each <br />post shall burn from dusk until midnight, or approximately two thousand (P000) hours <br />of service per year. <br />Aad the party of the second part further agrees that it will place <br />and install two hundred fifty (250) candle power lamps on the top of the posts, similie <br />to these which are now on Lafayette and Division Streets, at the dead ends of <br />Jefferson and St. Joseph Streets, Wayne and St. Joseph Streets, and Monroo and <br />Michigan Streets, where there are but two lamps at such intersections; Provided, howeve' <br />however, that if said installation at said dead ends should in the judgement of <br />the Board of Public Works be insufficient to light said iatorsectious, then said <br />Board may elect to have two more cluster l*ghts of the same kind as described in the <br />last preceding paragraph placed and installed across the street at each or amy of <br />said deed ends, which shall be done by the party of the second part after being <br />.-notified as to do, and the same shall be maintained for the same price as heroin <br />.� stated. <br />
