as shall have been actually received by the City from the assessments for such <br />improvement, or such moneys as said City is by said above entitled Apt required <br />to pay. All proceedings had, and work done in the making of said improvement, <br />assessment of property, collections of assessments and issuance of bonds therefor, <br />shall be as provided for -in said above entitled Act. , <br />Property owners signed waiver waiving all publ icat ions of resolution <br />and notice of bids. <br />This Board will r,aceivw bids for the construction of the above mentied <br />sewer up to 10:00 A.M. November 7th. ,1916. in accordance with waiver signed. <br />The Board reserves the right to reject any and all bids. <br />WAIVER. <br />South Bend, Indiana 10/31/169 <br />TO THE BOARD OF PUBLIC WORKS <br />SOUTH BEND, . IND IANA. <br />MREAS, the Board of Public Works of the City of South Bend, Indiana <br />did, on the 313t. day of October 1916 adopt a preliminary resolution for the improve- <br />ment of Portage Court from Portage Avenue to°132 feet east on Portage Court, in the <br />City of South Bend, Indiana, by construct ien of a sewer, Also the construction of <br />the necessary manholes, and inlets, water inlets conduits and resetting of all man -- <br />holes and inlets to the proper grade. All as shown on the plans, and in accordance <br />with the profiles, detail drawings andspec if icat ions on file in the off ice of the <br />Department of Public Works., <br />And Whereas, we, the undersigned, are the only persons owning <br />property on said street to be improved, and that we alone are affected°in any way <br />by said proposed improvement. That we are the sole owners of the separate parcels <br />of land bordering upon said street proposed to be improved. <br />Therefore, in consideration that said Board of Public Works proceed <br />to improve said street as proposed in said resolution, and for the further purpose of <br />saving time and exense we, the undersigned, do hereby waive all objections and <br />defense to any defect in said proceedings, and to any violation in procedure -for the <br />improvement of streets as fixed by Section 8710 of Burns Revised Stautues of 1914. We <br />further waive any and all objections to the fact that no advertisement for hearing <br />was published as required by law, and thtt no notices were sailed to the owners of <br />property and that no hearing was had by said Board. <br />> We also consent that said Board shall proceed to let the contra.et <br />for doing said work in the following manner: - <br />That they shall notify by mail re- <br />sponsible contractors in the City of South Bend, Indiana, of said work to be done <br />under said resolution, and that they shall receive bids from said contractors for <br />the doiaig of said work, and they shall let the contract for the doing of said work <br />to the lowest resDonsible bidder. :And we waive any objection to the action of said <br />Board in letting said contrcact-in a -form and manner other than provided by s-aid <br />Section 8710. <br />And we further consent that the cost of doing said work shall be <br />assessed against the different parcels of real estate owned by us as provided by <br />Sections 871096711,8714,8715,8716,871798718 of Burns Revised Statutes of 1914. <br />And we further agree that notice given us by mail shall be sufficent <br />notice of the hearing upon the assessment made for said improvement. <br />Giten under our hands on the day and year first above mentioned. <br />CHARLES E.
