<br />j Mr. F. I. Hardy, Mgr. of the Chicago, South Bend & Northean Indiana
<br />Ry. Company met with the Board and discussed ':the number`df-feet of clearance necessary
<br />at Chapin Street inA-,!�ded in 0 obvat fon of New York Central Tr*ck�. at that point, by their
<br />company, also the -clearance at other streets were discussed. —
<br />p Mr. Hardy advised
<br />the Board that he would take thds matter np•�with his a-Gtorney and report to the Board
<br />later.
<br />Ur. D. C. Layton, Street Commissioner had the matter up with the Board
<br />of p$umbers cutting into streets without permits. The Board advised that this matter
<br />be taken ul:x with the City Engineer. .
<br />Mayor F. W. Keller met with the Board and the natter of placing cluster
<br />lights in the downtown business streets was discussed. The Beard decided to take
<br />this matter up with Mr. F. A. Bryan of the Indiana & Michigan Electric Company in regard
<br />to prices.
<br />Petition received for vacation of alley running from Howard Street in
<br />northwesterly direction along west side of Michigan Central Railroad right of way to
<br />Leeper Avenue. The same wus read and referred to the City Engineer for investigation.
<br />Concerning the improvement of the roadway of La Porte Avenue from
<br />Washington Avenue to Linden Avenue by resurfacing with Asphalt, Asphaltic Concrete,
<br />Bithulithic, or Brick in pursuance. to Resolution No. 475 this being the day for receiving
<br />and opening of bids, the Board at 10:00 A.M. publicly opened, and considered all bids.
<br />And thereupon, the Board designated Sheet Asphalt as the kind of pavement
<br />with which said street is to be improved with and .f ixes the llth. day of November 1916
<br />at 10:00 A.Y. as the time when petitions must be filed, and the Board hereby-con-
<br />tin.uesthis matter until the 14th. day of November 1916, at 10:00 A.M. and all bids :were
<br />referred to the City Engineer for tabulation and he kas reported the lowest and best bid
<br />On the day above named the Board will either pass on petitions let said contract, or
<br />reject all bids.-

<br />Resolv::d by the Board of Public Works of the City of South Bend, County
<br />Of St. Joseph, State of Indiana, That the construct ion of a local serer, intended in
<br />and adopted only far local use by the pr operty holders whose property abuts thereon,
<br />dnd not intended or adapted for receiving sewerage from collateral drains, be and the
<br />same is, hereby ordered in and along Portage Court from Portage Avenue to the first
<br />alley easterly from Portage Avenue as follows, to -wit: -
<br />Beginning at the intersection of the center line of Portage Avenue and
<br />Portage Court; th,nee easterly along the center line of Portage Court to the first 14
<br />foot alley easterly from Portage Avenue with an 8 inch vitrified pipe sewer. Together
<br />with -the •necessary manholes, inlets, conduits and house connections to the curb line
<br />along the line of said improvement. All' as shown bn the plans and in accordance with
<br />profiles, detail drawings and s pee if icat ions on file in the office of the Department of
<br />Public Works of the Ciuy of South Bend, Indiana, and said sewer, with all its appurtenances
<br />shall be constructed in accordance with 'the prof iles and specifications now on file in the
<br />office of the Department of Public Works of said City. The cst of said improvement shall
<br />ne apportioned against and paid by the property holders whose property abuts thereon, and
<br />upon the City of South Bend, if the City is benefitted by said improvement, all accord-
<br />ing to the method and manner provided for in Act of the General Assembly of the State of
<br />Indiana, entitled,, " An Act Concerning Municipal Corporations," auproved March 6,1905.
<br />Assessments, if deferred, are to be paid in ten equal annual installments, with interest
<br />at the rate of Sixper cent per.�annum. A bond or bonds shall be issued to the contractor
<br />in payment for duck work, unless the property owners pay said assessments, before said
<br />bond or bonds are issued. Under no circumstances shall the City of South Bend be or be held
<br />responsible for any sum or sums due from said property owner or owners for said work, or
<br />for the collection of same, or for the payment of any bond or bonds, certificate or certiw
<br />issued to said contractor in payment for such work, except for suc1, moneys as shall have
<br />been actually received by the City from the assessments for such idrovement, or such moneys
