132 Tuesday May 9t h.,1916 . Continued. SIDEWALK IMPROVERENT RESOLUTION NO. 443. Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, That i.tnis deemed necessary to Improve' the south side of Calvert Street from Chapin Street to Franklin Street as follows, to -wit By • con- structing a cement sidewalk five (5) feet in width on the south side of said Calvert Street from Chapin Street to Franklin Street. All as shovn on the plans, and in accord- ance with the profiles, detail drawings and speci,fi cations on file in the office of the Department of Public Works of the City of South Bend, Ind is, m in accordance with the profile, detail drarrvings, ,specifications on file in the o-,rice of the Department of the Board of Public works of said City; knd such improvement is now ordered. The cost of said improvement, including the cost of street and alley inter- sections,, shall be assessed upon. the .real estate abutting on said South side of Calvert Street all according to themethod an ma,ner provided for in an Act of the General Assembly of the State of India':a, entitled " An Act Concerning Municipal Corporation , approved March 6,1905, and in accordance with and pursuant to the provisions of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. A ssessments , if deferred, are to be paid in ten equal amua1 install- meats, with interest at the rate of Six per cent per a.nnum. A bond or bonds small be issued to the contract in payment of such work, unless the property owners pay said assessments before said bond or bonds are issued. Under no ct:bcumstances shall the City of South Bend be, or be held responsible for any uum or sums due . from said property owner or owners for said worK or for the collection_ of the same, or for the payment of any bond, bonds, certificate or' certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assessment for such improvement, or such moneys as said City is by said' above entitled Act required to paY . All proceedings` had, and work done in the making of said improvement, assesanent of property, collection of assessments and issuance' of bonds therefor, shall be as provided for in said above entitled. Act and amendements the re t o. Notice of this resolution shall be published on the llth. day of May,1916 and lgth. day of May 1916 in the' South Bend Daily Tribune..
