LOCAL -SEWER IXPROVE�IENT RESOLUTION No. 426. ResOlved by the Bard of Plablic Works of the City of South Bend, County of St. Joseph, State of Indiana, That thel.construction of a local sewer, intended and adapted only for local use by the property holders whose property abuts thereon, and. not intend d or adapted for receiving sewerage from collateral drains, .be and the same is hereby ordered in and along Prances Street from South Bend Avenue to a point 100 feet slort h of the north line of Sorin Street, as follows, t o—wot :®Beginning at the center line of South Bend Avenue and Prances Street; thence South along the center line of Frances Street to the center of Campeau Street with a 15 inch vitrified pipe serer; thence still south along the center line of sid Frances Street to a point 100 feet nosh of the north line of Soria Street. Together with the necessary manholes, inlets, con— duits, flush tanks and house connections to the curb line 'along the line of said Improvement. All as shown on the plans add in accordance with profile, detail draw— ings and speci i.cations on file in the 0 flee of the Department of Public Works of the City of South Bend, Indiana, ...nd said sewer, with all its appurtenances shall be eon— structed in accordance with the profile and specifications now on file in the office -of the Department of Public Works of said City. The cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon' and upon the City of South Bend, if the City is benefitted my said improvement, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana entitled R An Act Concerning Municipal Corporations," approved March 611905 Assessments, if deferred, are to be paid in ten eQual annual installments with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in paym nt for such work, unless the property owners pay said assess— ments before said bonds or bonds are issued. Under no circumstances shall the City of South Bend be or be held responsible to any sum or sums due from said property owner or owners for said work, or for the collection of same, or for the payment of any bond or bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually renelved ?,,y fil-e City iret s evessmezAs for sue n improverte_el, s or „tie,: in,YS £; i:y is by sF1 ld e.b�ave entitled Act required to pay. All proceedings had, and work dne in the making of said, 6mprovement, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided for in said bove entitled Act. Notice of this resolution shall be published on the 1st. day of Ap -11,1916 and on the 8th. day of April 1916 in the South Bend Daily Tribune.
