Communication received by City Engineer Anderson from E.F.Seebirt,City <br />Attorney in regard to power of . cieaning out and deepening a natural stream running <br />through the City was presented to the Board. The same placed on file to be called up <br />for consideration intwo weeks or February 22nd. 1916 at 10:00 A.M. <br />Com munication received from Chief Kerr requesting that lumber be supplied <br />for the making of a cupboard in the Police station. The Clerk was instructed to give <br />the Chidf an order for the necessary lumber. <br />Engineer filed assessment roll of awards of damages an assessments of <br />benefits under Vacation Resolution No. 25 for the Vacation of a part of Lafayette St. <br />between'Broadway and Indiana Avenue, In the City of South Bend, Indiana. <br />Tae Board has ordered that notices of such awards of damages and assess- <br />ments of benefits be served according to law, and that a hearing be given on same on <br />29th. day of February 1916 at the office of the Board in the City Mall at 7:45 P.M. <br />for the purpose of nearing or receiving objections of any person or persons interested <br />in said matter. <br />The City Engineer submitted the list of property owners in the matter of <br />the appropriation oC bertain� property under condemnation Resolution No. 43 <br />for the Opening of Lafayette Street from 149 feet north of Indiana Avenue to Indiana <br />Avenue, as stated in resolution on page No.Iz wick list includes the names of <br />the owners and: holders of property and of interests therein sought to be taken or <br />beneficially or injuriously effected, and the description of the several pieces of <br />property which is affected by the said appropriation proceedings. <br />Thereupon the Board proceeded to award the damages sustained and to <br />assess the benefits accruing to each piece of property upon said list. <br />It was thereupon, upon motion duly made and seconded and unanimously <br />adopted, resolved that said list, together with the amounts of benefits and damages <br />and net benefits and net damages therein set forth as to the several parcels of land <br />be adopted and that the respective amount of benefits contained in said list be and <br />are hereby assessed against the several tracts of land as specifically set forth in said <br />list, and that the respective amounts of damages contained in the said list be and are <br />hereby awarded to the several tracts of land as specifically set forth in said list <br />and that the net benefits or net damages, as tyle case may be as to the respective <br />tract s of land, contained in said list are hereby awarded or assessed, as the case <br />may be as to the said several tracts of land. <br />The Board hereby further sets off the benefits and damages each against <br />the other Y&ere Yhoth benefits and damages are assessed against the same piece of pro- <br />perty, tract of land or interest, and hereby fixes said respective n_etbetefits as the <br />amount that shall be paid by the respective owners as benefits, and further hereby <br />fixes the respective net damages as to the several tracts as the amount that shall <br />be paid to the owners of the respective tracts as damages. _ <br />Thereupon, upon motion duly made and seended and unanimously adopted, <br />the 29t . day of February 1916 at 7:45 P.M. was fixed as the day on which this Board <br />will receive or hear remonstrances Pror persons with regard to the amount of their <br />respective awards or assessments, and the Clem; of this Board was instructed to pre- <br />pare and cause to be duly and legally given, notices to the owners of each parcel of <br />property, showing the amount of the assessment or award, wif h a description of the, <br />property affected, akW the date of said hearing. <br />
