Bill No. 12 -09 — Special Exception 1902 Western Avenue <br />Having been called upon by Chairperson Oliver Davis to give the BZA report, Mark <br />Lyons said while the Building Department staff reports to the BZA was favorable, the <br />request received a 4 -2 unfavorable vote. Mr. Lyons said this was due primarily due to <br />parking concerns there being only 5 spaces on site. Mark said the reason for the <br />exception was that while the building was previously a bar and was again hoping to open <br />as a bar it had been closed for over a year and lots its previous parking exemption. <br />Chairperson Oliver Davis then recognized Bruce Huntington, an attorney representing the <br />petitioners. Mr. Huntington noted the owners had a contingent lease for 22 more off - <br />street parking spaces. <br />During the Council portion, Councilmember Varner asked if special exemptions ran with <br />the owner or the land. The Council Attorney, Kathleen Cekanski - Farrand answered the <br />land. Councilmember Varner then said he would like to see a parking lease longer than 1 <br />year, more like 5. Councilmember Scott had concerns about the proximity to residences <br />and hours of operation. Mr. Huntington responded saying homes were no closer than any <br />other Western Avenue business. Also normal tavern hours of operation were expected. <br />He also said the petitioners were okay with presenting a 5 year parking lease. <br />At that, Councilmember Varner motioned the request be sent to Council favorably with <br />an agreement for a 5 year parking lease added.
