Which was a: -proved by the Board. <br />BOARD OF PUBLIC WORKS. <br />South.Bend, Indiana. <br />Gentlemen: - <br />Your' Petitioners, the Indiana & Michigan Electric Company, shows to <br />your Honorable Board that it is a corporation orgainzed under the laws of the State <br />of Indiana for the purpose of manufacture and d istr ibut idn-tof electricity for heat, <br />light and power for the use of the City of South Bend and the citizens thereof; that it <br />operates aid maintains a°plant for the manufacture of such electrical energy on the <br />corn r of Bridge and Colfac Avenue in said City; that electricity at said plant is <br />gene4ated by means of steam; that for the purpose of conveying coal and other supplies <br />-to said plant, petitioner has heretofore used a, siding or switch track leading from <br />the Michigan Central Railway Company's r ightef-way through what is known as the Old <br />Singer Plant and Crossing Mad is on Street a short distance crest of Em-rick Srreet in <br />said City of South Bend, that the use of said track has been in conjunction with <br />numberous other companies and institutions and that the common enjyyment of said switch <br />track has been do invonvenience to all of the said users, and at times has seriously <br />threatened the supply of cal of your petitioner at its said plant; that the require- <br />ments of said plant are in excess of twelve cars of coal daily arjjd the, storage capacity <br />of said plant is somewhat limited; thdt to safequard the continuous ,operation of said <br />lectric ial plant and to give it satisfactory access to the right-of-way of said <br />Michigan Central Railway Company,• pet it'ioners has atcons iderable expense acquired a <br />right-of-way over private pro erty to permit a s id ing which will intersect the existing <br />s iding leading to petitioner's Plant at a point north of Colfax Avenue and north of the <br />ast race, and' permit a connection with the Michigan Central Railway Company's tracks <br />at a point just north of Mad is on Street in said City; that. it is the intention of <br />Petitioner to immediately construct said s id4wg that In the construction of said s id ing <br />it is necessary to cross therewith public streets bf the City og South Bend, to= -wit:.. <br />Emerick Street, at a point on the easterly line thereof and near the north line of <br />Madison Street; thenee southwesterly across said Emerick Street and Madison Street and <br />passing put of said Street on a private right of way to a point on the west line of <br />Emerick Street and about thirty five (3 5) feet south of the south line of Mad is on <br />Street in said City of South Bend. ° <br />. .
