The Board after due consideration <br />it Tuesday June 8th.,1920 at 2 :00 P.M.' <br />peed by the Board. <br />RESOLUTION NO. 773, <br />Resolved by the Board of Public Works of the City of South Bend, <br />St. Joseph County, State of Indiana, That it is des it d and deemed necessary to <br />improve Walnut Street from Sampl® &tr eat to Prs it ie Avenue as follows, towit: - <br />Said street shall be graded from property line to property lines <br />to the established grade and cement sidewalk and cement .curb shall be constructed on -both <br />sides of the street from Sample Street to Prairie Avenue, all as is more particularly <br />shown and all in accordance with the plans, pro ilex, detail drawings and spa f is i.ations <br />on file in the office of the Department of Publ c Works o the City of South Bend, <br />Ind iena. <br />The cost of the improvement, including the cost of the street and alley <br />intersections, shall be assessed upon the real Dstate on said Walnut Street all <br />according to the method and manner provided for -in an Act of the General Assembly of <br />the State of Indiana, entitled " An Act Concerning Muncipabl Corporations," approved. <br />March 6,19,05, and in accordance with and pursuance to prov is ions of all am ndatory <br />and supplemental acts thereto, passed by the General Assembly of the State of Indiana, <br />Assessments, if deferred, are to be paid in ten equal annual installmets, with interest <br />at the rate of Six per cant per annum. A bond r bonds shall be issued to the contractor <br />in payment of such work, unless the property owners pay said assessment before said <br />bond or bonds are issued. Under no circumstances the the City of South Bend, . be or be he] <br />responsible for the any sum or sums due from said property owner or owners for said <br />work or for the collection of the same, or for the payment of any bond, bonds, certi- <br />ficates, issued to said contractor in payment for such work, except for such moneys <br />as shall have been aotua lly received by the City from the assessments for such improve- <br />ment. or such moneys as said City is by said above entitled Act required to pay. All <br />proceedings had, and work done in the making df said improvement, assessment of property <br />collection of assessments and issuance of bonds therefor, shall be as providedfor in <br />said above -entitled Act and amendments thereto. <br />Notice of this resolutions all be published en the 6th. day ct- <br />May 1920 and on the 13th. day -of May 1920. in the South Bend Daily Tribune.
