Area Board of Zoning Appeals—January 4, 2012 <br /> A motion to send the Special Exception to the Common Council with an unfavorable recommendation with <br /> the condition that if it is approved by the council that no alcoholic beverages allowed was made by Mr. <br /> Phipps and seconded by Mr. Hawley. The motion carried unanimously. <br /> A motion to send the petition for Special Exception to the Common Council with an Unfavorable <br /> Recommendation with the condition that if approved by the Council that no alcoholic beverages are allowed <br /> was made by Mr. Phipps and seconded by Mr. Hawley. The motion carried unanimously. <br /> After hearing the evidence on the petition., the Area Board of Zoning Appeals find that you did not <br /> satisfy the Standards as set forth in I.C. 36-7-4-918.5; therefore, the petition for Special Exception <br /> was sent to the Common Council with an Unfavorable Recommendation and if the Special <br /> Exception is approved no alcoholic beverages are allowed and the petition for variances granted with <br /> exception of variance number two and seven as submitted in the revised petition and subject to the <br /> Special Exception being approved. <br /> Based on the testimony presented, the Area Board of Zoning Appeals, after careful consideration, finds this <br /> petition for Special Exception sent to the Common Council with an Unfavorable Recommendation and if <br /> the Special Exception is approved that no alcoholic beverages are allowed and the variances granted with the <br /> exception of variance number two and seven as submitted in the revised petition and subject to the Special <br /> Exception being approved and will issue written Finding of Facts. <br /> PETITION FOR VARIANCES GRANTED WITH THE EXCEPTION OF VARINACE NUMBER. <br /> TWO AND SEVEN AS SUBMITTED IN THE REVISED PETITION AND SUBJECT TO THE <br /> SPECIAL EXCEPTION APPROVED BY THE COMMON COUNCIL <br /> PETITION FOR SPECIAL,EXCEPTION SENT TO THE COMMON COUNCIL WITH AN <br /> UNFAVORABLE RECOMMENDATION AND IF THE SPECIAL IS APPROVED THAT IT IS <br /> WITH THE CONDITION THAT NO ALCOHOLIC BEVERAGES ARE ALLOWED <br /> 31 <br />
