Area Board of Zoning Appeals—January 4, 2012
MR. VELLEMAN: Well there's actually eight variances, well actually seven variance and on Special
Exception so...do take it line by line if you've got an updated one because...
MR. FEDDER: Well I don't have an updated one either.
MR. VELLEMAN: I guess my question is, I agree with you on the parking, but the existing building needs
three variances on it as it is right now even if anything was not to change they would those three variances
without the parking.
MR. PHIPPS: I would be in favor of approving the variances for the location of the existing building.
MR. VELLEMAN: We can't change the building. I mean that's what it boils down to, so...since there's
numbers on their request, can we take it number by number?
MR. PHIPPS: Well the two variances that I would move that we deny would be the reduction of the on site
parking spaces and the...
MR. VELLEMAN: Number six, to allow one parking space closer from the required 15'to Terrace Lane
down to 8'?
MR. PHIPPS: Well I can see with any use of that building there might be some encroachment of parking
into that. I guess the two that the Plan Commission recommended I would deny those two, the screening
from the residential area and the number of parking spaces.
MRS. HENRY: So you're talking number two and number seven?
MR.VELLEMAN: Gotcha.
MR. PHIPPS: Likely if we deny those two it would require another site plan.
MR. URBANSKI. We have a motion on the floor, do we have a second?
MR. PHIPPS: Then if the ones we approve would be subject to the Special Exception being approved.
MR. VELLEMAN: Second.
MR. URBANSKI: Call for the vote please.
MRS. HENRY: We have a motion to deny variance number two and seven of the revised petition which
deal with the number of parking spaces and the screening and subject to the Special Exception being
approved by the Council was made by Mr. Phipps and seconded by Mr. Velleman. Mr. Young?
MR. YOUNG: Yes.
29
