REGULAR MEETING JUNE 27, 2011 <br /> <br /> <br /> <br /> <br />ORDINANCE NO. 10101-11 AN ORDINANCE OF THE COMMON COUNCIL <br /> OF SOUTH BEND, INDIANA, FOR BUDGET <br />TRANSFERRING $2,931,000 FROM THE <br />RAINY DAY FUND NO. 102 TO THE HALL OF <br />FAME DEBT SERVICE FUND 313 ($416,000), <br />FIRE PENSION FUND 701 ($1,200,000), POLICE <br />PENSION FUND 702 ($1,200,000) AND <br />UNEMPLOYMENT COMPENSATION FUND <br />713 ($115,000) WITHIN THE CITY OF SOUTH <br />BEND <br /> <br />This bill had third reading. Councilmember Puzzello made a motion to pass this bill. <br />Councilmember Varner seconded the motion which carried. This bill passed by a roll <br />call vote of nine (9) ayes. <br /> <br /> <br />ORDINANCE NO. 10102-11 AN ORDINANCE OF THE COMMON COUNCIL <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />APPROVING BLOCK PARTY APPLICATIONS <br />FEE <br /> <br />This bill had third reading. Councilmember White made a motion to amend this bill as in <br />the Committee of the Whole. Councilmember Varner seconded the motion which carried <br />by a voice vote of nine (9) ayes. Additionally, Councilmember Varner made a motion to <br />pass this bill as amended. Councilmember Oliver Davis seconded the motion which <br />carried. The bill passed by a roll call vote of nine (9) ayes. <br />. <br /> <br />RESOLUTIONS <br /> <br />BILL NO. 11-30 A RESOLUTION OF THE COMMON COUNCIL <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />APPROVING A PETITION OF THE AREA <br />BOARD OF ZONING APPEALS FOR THE <br />PROPERTY LOCATED AT 1019 TALBOT <br />AVENUE AND 1023 TALBOT AVENUE, <br />SOUTH BEND, IN 46617 <br /> <br />Councilmember Kirsits, Chairperson, Zoning & Annexation Committee, reported that <br />this committee held a Public Hearing on this bill this afternoon and voted to send it to the <br />full Council with no recommendation. <br /> <br />Chuck Bulot, Building Commissioner, 125 S. Lafayette Blvd., South Bend, Indiana, <br />presented the report from the Area Board of Zoning Appeals. <br /> <br />Mr. Bulot advised that the petitioner is seeking a special exception for a two family <br />dwelling in a SF2” District, on property located at 1019 & 1023 Talbot Street. He stated <br />that the Area Board of Zoning Appeals held a public hearing on April 6, 2011 and sends <br />this bill to the Common Council with a favorable recommendation. <br /> <br />Frank Agostino, Attorney, 120 W. LaSalle Avenue, Suite 704, South Bend, Indiana, <br />made the presentation on behalf of his client, Cosimo Bumbaca. <br /> <br />Mr. Agostino advised that this is a private investment by a private developer in the City. <br />He stated that his client has purchased and cleaned up several properties that he has <br />bought and does not have any code violations that he has been charged with or convicted <br />of, even though there have been many allegations flying around that are to the contrary. <br />Mr. Agostino reiterated to focus on that this is a private investment and urged the Council <br />to support a private investment to improve the neighborhood. He stated that this <br />neighborhood has mostly rental houses in it. He stated that a concern of zoning was <br /> 14 <br /> <br />
