Ms. Fritzberg seconded the motion which <br />carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE THE EAST/WEST ALLEY <br />FROM HILL STREET TO NORTH/SOUTH ALLEY BETWEEN CORBY BLVD. AND <br />KALORAMA ST. <br />Mr. Gilot indicated that Century Builders, Inc., 820 N. Hill Street, South Bend, IN 46617, has <br />submitted a request to vacate the above referenced alley. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Area Plan <br />Commission, Fire Department, Streets Department, Community Investment and Engineering, all <br />stating the vacation would not hinder the growth or orderly development of the unit or <br />neighborhood in which it is located or to which it is contiguous; the vacation would not make <br />access to the lands of the aggrieved person by means of public way difficult or inconvenient; the <br />vacation would not hinder the public's access to a church, school or other public building or <br />place; and the vacation would not hinder the use of a public right-of-way by the neighborhood in <br />which it is located or to which it is contiguous. Therefore, Ms. Maradik made a motion <br />recommending approval of the request for vacation. Ms. Fritzberg seconded the motion which <br />carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Maradik, seconded by Ms. Fritzberg and carried, the following <br />traffic control device requests were approved: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATIONS: 1133 Roosevelt St. <br />1942 E. Fox St. <br />942 S. 36" St. <br />REMARKS: All criteria has been met <br />REMOVAL: Six (6) "No Parking, 7:00 a.m. to 4:00 p.m." Signs no <br />longer needed at former Xavier School of Excellence <br />LOCATIONS: West side of South Michigan Street between Tasher St. and <br />Sherwood St. <br />REMARKS: All criteria has been met <br />DENY TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Maradik, seconded by Ms. Fritzberg and carried, the following <br />traffic control device requests were denied: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATIONS: 2415 Prast Blvd. <br />604 Cottage Grove Ave. <br />801 Turnock St. <br />REMARKS: All criteria has not been met; Accessible Driveway <br />APPROVE CONSENTS TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of the following Consent to Annexation and Waiver <br />of Right to Remonstrate. The Consent indicates that in consideration for permission to tap into <br />the public water system of the City, to provide water service to the below referenced property, <br />the applicant waives and releases any and all rights to remonstrate against or oppose any pending <br />or future annexations of the property by the City of SouthBend: <br />A. Place Homes, Inc., 1620 N. Ironwood, South Bend, IN 46635 <br />1. 51605 Audubon Woods Drive — Water (Key No.002-1003-005733) <br />Upon a motion by Ms. Maradik, seconded by Ms. Fritzberg and carried, the Consent to <br />Annexation and Waiver of Right to Remonstrate was approved as submitted. <br />RATIFY APPROVAL AND/OR RELEASE CONTRACTOR EXCAVATION AND <br />OCCUPANCY BONDS <br />
