.= <br />REGULAR MEETING <br />DECEMBER 11, 2007 <br />made by Mr. Cottrell, seconded by Ms. Dempsey and carried, the retirement was accepted and <br />approved. <br />ACCEPT AND APPROVE RETIREMENT -CHIEF THOMAS FAUTZ <br />President Alford advised that Mayor Stephen Luecke has submitted to the Board the Application <br />and Declaration for Retirement for Chief Thomas Fautz, effective December 28, 2007. In his <br />letter, Mayor Luecke noted that Chief Fautz is retiring in good standing after serving for the last <br />thirty-four (34) years, five (5) months, and five (5) days. Mayor Luecke joined the Board in <br />thanking him for his years of distinguished service to the South Bend Police Department and the <br />citizens of South Bend. Members also wished him a long and happy retirement. Upon a motion <br />made by Mr. Cottrell, seconded by Ms. Dempsey and carried, the retirement was accepted and <br />approved. <br />Board President Donald Alford asked Chief Fautz if he would like to say a few words before the <br />Board continued with the agenda. Chief Fautz stated he would like to thank the Board for their <br />help over the last five (5) years. He noted that a lot of times people don't understand why things <br />are done the way they are, but the Board has done a good job of administering the rules and <br />regulations of the Police Department. <br />Mr. Cottrell stated he was on the Police Department when this group of retirees came on, and in <br />his twenty-some years on the department this is the best group to come on. He noted that he <br />worked with Chief Fautz when he was an officer of the Police Department, and he was a great <br />officer and continues to be a great leader. He stated that he hopes to get a Chief that takes the <br />Department in the same direction Chief Fautz is going, and thanked Chief Fautz for the great job <br />he has done. <br />APPROVE LETTER OF UNDERSTANDING <br />Mr. Bodnar requests the Board's approval of a Letter of Understanding between the City of <br />South Bend and the Fraternal Order of Police concerning the holiday schedule for Police <br />Department School Resource Officers, and the amount of rebate for officers using another health <br />care provider instead of the City's health insurance. The holiday schedule was amended in <br />amended Resolution No. 43-2007 to provide for a separate holiday schedule for those officers's <br />working in the school system. The Letter of Understanding regulates the amount of rebate to be <br />$92.50 per pay period for the remainder of 2007 for those officers's not using the City's health <br />insurance, under Article 20, Section 6 of the Working Agreement of the Police Department. <br />APPROVE AMENDED RESOLUTION NO.43-2007 <br />In a Memorandum to the Board, Mr. Tom Bodnar, Board Attorney, requests the Board approve <br />the following amended resolution regarding Police Department holidays. The amended <br />resolution addresses the issue of holidays for South Bend Police Department School Resource <br />Officers. These officers follow a holiday schedule based upon the South Bend teacher's holiday <br />schedule. Although they don't have as many holidays as the teacher's, they do have two more <br />days than the regular Police Department holiday schedule. This was missed in the original <br />Resolution No. 43-2007. Upon a motion by Mr. Cottrell, seconded by Ms. Dempsey and carried, <br />the following amended Resolution was approved by the Board of Public Safety: <br />RESOLUTION NO. 43-2007 <br />AMENDED RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF <br />SOUTH BEND, INDIANA ESTABLISHING THE 2008 HOLIDAY SCHEDULE FOR THE <br />SOUTH BEND POLICE DEPARTMENT <br />WHEREAS, the Board of Public Safety of the City of South Bend, Indiana, is <br />empowered by law to establish rules and regulations for the South Bend Police Department; and <br />WHEREAS, it is in the interest of the City of South Bend that the Police Department <br />holidays be set with certainty. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Safety of the City of <br />South Bend: <br />1 <br />1 <br />1 <br />SECTION I. That for all sworn police officers who are assigned to work as their regular <br />schedule, 5 on and 2 off, Monday through Friday, the following holidays shall apply: <br />
