license. <br />(g) Denial of License. <br />(1) The license of a Tier 1 hotel shall be issued upon submission of application and <br />payment of fee. The license of a Tier 2 or Tier 3 hotel shall be issued upon submission of <br />application; payment of fee, and upon inspection performed by the .South Bend Police <br />Department indicating that the owner is in substantial compliance with the operations <br />requirements of a Tier 2 or Tier 3 hotel. <br />(2) The City may deny issuance of a license to any Tier 2 or Tier 3 hotel which the South <br />Bend Police Department inspection fmds to be not in compliance with the. Tier 2 or Tier 3 <br />operation requirements. The owner shall have a period of thirty (30) days to correct the <br />deficiency and request issuance of the license. Failure to show proof within thirty (30) days that <br />the deficiency has been corrected shall constitute waiver of the owner's right to contest the <br />denial. <br />(3) If upon owner's submission of proof of corrected deficiency, the City may deny the <br />license if it finds that the owner's corrective measures do not cure the deficiency, and the matter <br />shall be scheduled for administrative hearing within thirty (30) days of the City's second denial. <br />(4) An owner who has submitted an application, paid the license fee, and shown proof of <br />correction following denial may continue to operate unless and until notified that the correction <br />is inadequate. <br />(h) Revocation of License. <br />(I) The annual hotel license of any tier hotel shall be subject to revocation by the City <br />Controller or designee upon good cause shown that the operation of •the hotel constitutes <br />endangerment of the health, safety, and/or welfare of guests or residents of the neighboring <br />community by any of the following: <br />(a) Non-compliance with federal, state laws or the South Bend Municipal Code. <br />(b) Occurrence of drug related arrests of guests, employees, or visitors. <br />(c) Prostitution related arrests of guests, employees, visitors or others. <br />(d) Substantial and significant increase in CFS/Room Ratio. <br />(2) The license holder shall be entitled to written notice of the basis for revocation <br />including the dates when the occurrences took place, a history of the calls for service, and nature <br />of the violations. A hearing shall be scheduled and the owner and operator identified in the <br />license holder's application shall be given notice of the hearing date and time. <br />-6- <br />
