the classification Tier within the City of South Bend of the hotel as determined in subpart (b)(2) <br />of this Section which fees are as follows: <br />Tier 1 - $135.00 <br />Tier 2 - $175.00 <br />Tier 3 - $505.00 <br />(2) The license application shall include the following: <br />a. Name, address, and telephone number of intended operator. <br />b. Trade name and street address of hotel. <br />c. State and date of incorporation of operator if operator is a corporation. <br />d. Name and phone number of person to be contacted in an emergency. <br />Failure to provide or material misrepresentation of required information shall be grounds <br />for denial of the license. <br />(3) A hotel which has not previously operated in South Bend shall be presumed to be a <br />Tier 1 hotel for purposes of licensing and fees for the fast year of its operation. <br />(4) A hotel must submit its application for license renewal by February 28~' of each <br />calendar year based upon its classification Tier for that year as determined by the South Bend <br />Police Chief or designee. <br />(5) The license acquired from the City shall be prominently displayed at all times in the <br />hotel where it is visible to registering guests. <br />(6) Each license shall expire February 28`~ of the year following the year in which it is <br />issued, and may be renewed only by making application as provided in Subsection 1 above. <br />Application for renewal should be made at least twenty (20) days before the expiration date, and <br />when made less than twenty (20) days before the expiration date, the expiration of the license <br />will not be affected. <br />(f) Change of Hotel Tier Classification . The City may change the status of any Tier 1 or Tier 2 <br />hotel operator during a calendar year upon notice in writing to the owner that the CFS /Room <br />Ratio of such hotel has increased proportionately such that the CFS /Room Ratio if annualized <br />would fall within the Tier 2 or Tier 3 level. Upon such notice, the owner shall have ten (10) days <br />from the date of notice to show proof that the revised CFS is erroneous, and shall have thirty (30) <br />days from the date of notice to implement the changes in operation required by the revised <br />classification and to pay the difference between Tier 1 license and the Tier 2 or Tier 3 license, <br />whichever is applicable. Failure to comply with this provision may result in revocation of the <br />-5- <br />
