<br />SIDEWALK IMPROVEMENT RESOLUTION NO. 1097.
<br />Resolved by the Board of Public Works of the City of South Bend,
<br />St. Joseph County, State of Indiana, That it is deemed necessary to improve Dayton
<br />Street from -the alley west of Kline Street to the west line of Robinson Is S . econd
<br />AAAiCin" AS follows tonwito.—
<br />Saif street shall be graded from property line to
<br />property line to the established grade and cement sidewalk and cement curb shall be
<br />constructed on both sidesof said Dayton Street from the alley west Of Kline Street to
<br />the west line of Robinson Is Second Addition. All as is more particularly shown and
<br />all in accordance with the plans, profiles, detail drawings and specifications on file
<br />in the office of . the Department of Public Works of the City of South Bend$ Indiana.
<br />in aocordance with the , -)lans, profiles , detail drawings and speoificationS
<br />on file in the ioffice df the Departnent of the Board of Public Works of said
<br />City; and such improvement is now orde-Ted.
<br />The coat of said improvement,, including' the cost of street and alley
<br />intersections, shall be assess-ed upon the real estate abutting on said

<br />all according. to the method any malMer provided for in an Act of the Gan -
<br />oral Assembly of the St,:Dte- of Indian::,,, entitled "An Act Concerning M=iQjpA!_%
<br />Corporations, appric Tjrec9. 1,905, and in ac-cordance with and varquant to
<br />the , provisions of all C-trnp-3-tory and supplemental acts thereto, paseed by the
<br />General Assembly of the State of Indianao Assessments, if deferred, are to be
<br />paid in ton equal annual installments, with interest at the rate of Six Per
<br />cent per. annum. A bona or bonds shall be issued to the contractor in payment
<br />of such work, unless the property owners pay said assessment before said bond
<br />or bonds are issued. Under no cl rcu-nst once s shall. the City of South Bend, be,
<br />or be held responsible for any sum or sums, due from said property owner or
<br />owners for said work or for the collection of the same, or for the payment of
<br />bonds, bonds., certificate or certifi-cates, issued to said contractor in pay-
