REGULAR MEETING NOVEMBER 14, 2011 <br /> <br /> <br /> <br /> <br />RESOLUTION NO. 4128-11 A RESOLUTION OF THE COMMON COUNCIL <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />AUTHORIZING THE CITY OF SOUTH BEND <br />TO PARTICIPATE IN THE INDIANA FINANCE <br />AUTHORITY ABANDONED LANDFILL <br />INITIATIVE COALITION FOR THE PURPOSE <br />OF SUBMITTING AN APPLICATION TO THE <br />UNITED STATES ENVIRONMENTAL <br />PROTECTION AGENCY FOR A <br />BROWNFIELDS COMMUNITY-WIDE <br />ASSESSMENT GRANT <br /> <br />WHEREAS, the United States Environmental Protection Agency has financial <br />assistance for brownfield revitalization, including grants for community-wide site <br />assessments; and <br /> <br />WHEREAS, the Indiana Finance Authority Abandoned Landfill Initiative <br />Coalition (Coalition) intends to request a $1,000,000 Brownfields Assessment Grant for <br />assessment of former landfills within the State of Indiana; and <br /> <br />WHEREAS, the City of South Bend has been asked to be a member of the <br />Coalition in order to address abandoned landfills in South Bend; and <br /> <br />WHEREAS, the Mayor is the Chief Executive Officer of the City and is the <br />appropriate individual to represent South Bend in this Coalition. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of <br />South Bend, Indiana, as follows: <br /> <br />SECTION I. That the Mayor of the City of South Bend, Indiana, is hereby <br />authorized to represent the City of South Bend in the Coalition and the Coalition’s <br />application to the United States Environmental Protection Agency for a $1,000,000 <br />Brownfields Assessment Grant and to execute all documents related to any grant <br />awarded. <br /> <br />SECTION II. That the Mayor of the City of South Bend, Indiana, shall file with <br />the Common Council a complete copy of the Coalition’s application submitted to the <br />United States Environmental Protection Agency. <br /> <br />SECTION III. That the City of South Bend, Department of Community and <br />Economic Development is hereby designated as the agency and office participating in the <br />Coalition on behalf of the City of South Bend, for the Assessment Grant awarded under <br />this application. <br /> <br /> <br />SECTION V. That this resolution shall be in full force and effect from and after <br />its adoption by the Common Council and approval by the Mayor. <br /> <br /> s/Derek D.
