appropriated by the South Bend Common Council, which annual amount shall in no event be less <br /> than Two Hundred Twenty-five Thousand and 00/100 Dollars ($225,000.00). Compensation for <br /> calendar years 2011 through 2015, inclusive, so appropriated by the South Bend Common <br /> Council shall be paid to SNM in twelve (12) equal monthly installments beginning on or about <br /> January 1, 2011, and monthly thereafter as scheduled. An increase of Compensation in any one <br /> calendar year during the "First Management Renewal Period" shall not be construed to mean that <br /> Compensation in any subsequent year must or should exceed the base sum of$225,000.00. <br /> 4. The effective date of this Amendment to Article III of the Agreement shall be <br /> January 1, 2011, and the Amendment shall terminate midnight Eastern Standard Time on <br /> December 31, 2015 unless renewed in advance of that date. <br /> 5. This Amendment applies solely to Article III of the Agreement and all of the <br /> other terms and provisions of the Agreement remain in full force and effect. In the event of any <br /> inconsistency, this First Amendment shall be given controlling effect. <br /> 5. This First Amendment may be executed in counterparts with the same effect as if <br /> both parties hereto had executed the same document. Both counterparts shall be construed <br /> together and shall constitute a single document. The parties hereto agree that the use of facsimile <br /> or electronic signatures for the execution of this First Amendment shall be legal and binding and <br /> shall have the same full force and effect as the original document. <br /> 7. F,-Verify Program. SNM affirms under the penalties of perjury that he/she/it does <br /> not knowingly employ an unauthorized alien. SNM shall enroll in and verify the work eligibility <br /> status of all his/her/its newly hired employees through the E-Verify program as defined in I.C. <br /> 22-5-1.7-1 SNM shall not knowingly employ or contract with an unauthorized alien. SNM <br /> shall not retain an employee or contract with a person that SNM subsequently learns is an <br /> unauthorized alien. <br /> SNM is not required to participate in the E-Verify program should the E-Verify <br /> program cease to exist. Additionally, SNM is not required to participate if SNM is self- <br /> employed and does not employ any employees. SNM shall require his/her/its subcontractors, <br /> who perform work under this contract, to certify to SNM that the subcontractor does not <br /> knowingly employ or contract with an unauthorized alien and that the subcontractor has enrolled <br /> and is participating in the E-Verify program. SNM agrees to maintain this certification <br /> throughout the duration of the term of a contract with a subcontractor. <br /> The City may terminate for default if SNM fails to cure a breach of this provision <br /> no later than thirty (30) days after being notified by the City. <br /> 8. Minority and Women's Enterprise Diversity Development. Persons, partnerships, <br /> corporations, associations, or joint venturers awarded a contract by the City of South Bend <br /> through its agencies, boards, or commissions shall not discriminate against any employee or <br /> applicant for employment in the performance of a City contract with respect to hire, tenure, <br /> terms, conditions, or privileges of employment, or any matter directly or indirectly related to <br />
