("SNM") on August 12, 2005, This agreement set the conditions for the museum lease of <br /> the city owned building and established the relationship whereby the SNM would operate the museum <br /> under contractual agreement with the city. The original agreement expired on December 31, 2010. <br /> The parties (SNM and City) have continued their contractual Management Agreement on a month to <br /> month basis, and both parties desire to amend and renew the Management Contract for another five (5) <br /> year term. <br /> The First Amendment to the Lease and Management Agreement is attached and is submitted as exhibit A <br /> to Council Bill 80-11. This bill, upon approval of Council, will authorize the Board of Public Works to <br /> execute the agreement on behalf of the City of South Bend, and set January 1, 2011 as the effective date <br /> of the amended Lease and Management Agreement. <br /> Terms of the 1 s'Amendment to the Lease and Management Agreement include: <br /> • Renewal of the agreement for a five (5) year term expiring December 31, 2015, with three (3) <br /> automatic options for five(5)year extension, <br /> • Set minimum annual management fee at$225,000, <br /> • Inclusion of standard e-verify and MBE contractual language. <br /> Mayor Luecke will present this bill to the Common Council at the appropriate Council Committee meeting, <br /> public hearing, and at the Council meeting.
