761 <br />Sentembe r 7th.19z 5. <br />Permission was granted to the Central Union Telepnone Company,to set one <br />30 foot pole on the south side of alley east of Blaine Ave. hetween McCartney and King <br />Street. 40 ft. from Home Tel. Co. pole opposite side of alley. <br />Tile Follow;~ig letter was received from the City Attorney. <br />Board of Publi Works, <br />South Bend, Ind. <br />Gent lemen: — <br />I herewith returning to you a certain remonstrance signed by 34 citizens against <br />the asphalt plant located on yards of Vandalia Railway Co., and I advise you as follows: — <br />There is no -ordinance declaring an asphalt plant to be a nuisance, therefore <br />I` can bring no prosecution for the same'. If this plant is a nuisance to the citizens <br />within that locality, they doubtless would have a cause t)f action for injunction which they <br />or any of them could bring in the Circuit of Superior Court. <br />. However, I presume that the business of this plant is to furnish asphalt for <br />street improvements, which are within the control of the Board of Public Works, and a sugges— <br />tion from you to these peope to the effect that it night be desirable for them to move <br />t,e _r pl2..nt 'P�rould probe.bly have some effect. <br />Yours very trtzl_Y, <br />ELI F.
