RESOLUTION NO. 1055 <br />RESOLUTION OF THE SOUTH BEND REDEVELOPMENT <br />COMMISSION TRANSFERRING REAL PROPERTY <br />TO THE COUNTY OF ST. JOSEPH, INDIANA <br />WHEREAS, the City of South Bend, Department of Redevelopment <br />(hereinafter, the "Department of Redevelopment "), a governmental <br />entity, is the owner of a parcel of real property, situated in St. <br />Joseph County, Indiana, and being more particularly described as <br />follows: <br />The North 74.5 feet of the following: The East <br />3/4 of Lot Sixteen (16) in Ann Thomas' Subdivision <br />of Bank Out Lot 74 of the State Bank's First <br />Addition to the City of South Bend, and bounded as <br />follows: Commencing at the Southeast corner of <br />said Lot 16; thence North to the Northeast corner <br />thereof; thence West 72 3/8 links; thence South to <br />the South line of said Lot 16; thence East 72 3/8 <br />links to the place of beginning. Commonly known <br />as 906 West Jefferson Boulevard, South Bend, Key <br />No.: 18- 3054 -2111; <br />and <br />The South Half of a lot or parcel of land bounded <br />by a line running as follows: Beginning at a <br />point 72 3/8 links West of the Southeast corner of <br />Lot Numbered Sixteen (16) as shown on the recorded <br />Plat of Ann Thomas' Subdivision of the middle part <br />of Bank Out Lot 74 of the First Plat of Out Lots <br />of the Town, now City of South Bend, platted by <br />the State Bank of Indiana, thence running West 72 <br />3/8 links; thence North to the North line of Lot <br />Seventeen (17) in said Subdivision; thence East 72 <br />3/8 links, thence South to the place of <br />beginning. Commonly known as 911 West Thomas, <br />South Bend, Key No.: 18- 3054 -2110, <br />(hereinafter referred to as the "Real Property "); and <br />WHEREAS, pursuant to I.C. 36- 7- 14 -3(a), the Department of <br />Redevelopment is governed and controlled by the South Bend <br />Redevelopment Commission (hereinafter, the "Commission "); and <br />WHEREAS, pursuant to I.C. 36- 7- 14- 12.2(a)(3), the Commission may <br />transfer real property acquired for redevelopment purposes to any <br />other governmental entity upon such terms and conditions as may be <br />agreed upon; and <br />WHEREAS, pursuant to I.C. 36 -7 -14 -12.2, the Commission is <br />authorized to acquire and dispose of real property for use or in <br />connection with the redevelopment of blighted areas; and <br />WHEREAS, the Department of Redevelopment is desirous of <br />transferring title to the Real Property to the County of St. Joseph <br />(hereinafter, the "County ") so that the same may be utilized in the <br />revitalization of the West Washington /Chapin Revitalization Area; and <br />WHEREAS, the County is desirous of acquiring the Real Property <br />from the Department of Redevelopment in order to allow for the <br />development of an historic preservation museum and educational <br />complex; and <br />WHEREAS, pursuant to I.C. 36- 1 -11 -8, the County may accept the <br />transfer of Real Property from the Commission upon the adoption of <br />substantially identical resolution adopted by its governing body; and <br />
