MICHIGAN <br />STREET — JCD HOLDING LLC <br />Mr. Gilot stated a Revocable Permit has been received for the purpose of allowing a gas meter <br />relocation in the right-of-way at 119 N. Michigan St. The encroachment shall remain in the right- <br />of-way until such time as the Board of Public Works of the City of South Bend shall determine <br />that such encroachment is in any way impairing or interfering with the highway or with the free <br />and same flow of traffic. Engineering requested bollards be installed for safety. Upon a motion <br />made by Ms. Maradik, seconded by Ms. Fritzberg and carried, the Revocable Permit was <br />approved subject to installation of bollards. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE THE NORTH/SOUTH <br />ALLEY EAST OF CHESTNUT ST. AND WEST OF WALNUT ST., BOUNDED ON THE <br />NORTH BY EAST/WEST ALLEY SOUTH OF NAPIER ST., BOUNDED ON THE SOUTH <br />BY THE NORTH RIGHT-OF-WAY OF NORFOLK SOUTHERN RAILROAD <br />Mr. Gilot indicated that Masterbilt, Inc., 325 S. Walnut St., South Bend, IN 46601, has submitted <br />a request to vacate the above referenced alley. Mr. Gilot advised the Board is in receipt of <br />favorable recommendations concerning this Vacation Petition from the Area Plan Commission, <br />Fire Department, and Street Department. Mr. Gilot advised the Board is in receipt of unfavorable <br />recommendations concerning this vacation petition from the Engineering Department and <br />Community Investment. Community Investment stated the vacation would make access to the <br />lands of the aggrieved person by means of public way difficult or inconvenient. They noted there <br />is City -owned property at the southeast corner of Chestnut and the railroad would be impaired <br />without access via this alley. The Engineering Department stated vacating this alley would limit <br />access to City -owned property at the far south end of Chestnut Street. Therefore, Ms. Maradik <br />made a motion recommending unfavorably for the request for vacation. Ms. Fritzberg seconded <br />the motion which carried. <br />TABLE PETITION TO VACATE THE EAST/WEST PORTION OF FAIRVIEW ST., EAST <br />OF GRANT ST. AND WEST OF BROOKFIELD ST <br />Mr. Gilot indicated that Romero Juan Zapien, 2427 S. Brookfield St., South Bend, IN, has <br />submitted a request to vacate the above referenced street. Mr. Gilot advised the Board is in <br />receipt of favorable recommendations concerning this Vacation Petition from the Area Plan <br />Commission, and the Engineering and Community Investment Departments. Mr. Gilot advised <br />the Board is in receipt of unfavorable recommendations concerning this vacation petition from <br />the Street Department and Fire Department. The Fire Department stated the vacation would <br />make access to the lands of the aggrieved person by means of public way difficult or <br />inconvenient. They noted there are structures near this alley and the only hydrant for the Fire <br />Department to use is just west of the north/south alley that connects to the east/west alley being <br />requested to be vacated. The Street Department stated the area appears to be privately owned and <br />does not have the characteristics or resemble a portion of Fairview Street in any way. He noted <br />that the area was never developed to the point of receiving street names, therefore Grant Street <br />and Fairview Street do not exist as described in this vacation request. Therefore, Mr. Gilot made <br />a motion to table the request for vacation for further information. Ms. Maradik seconded the <br />motion which carried. <br />
