REGULAR MEETING JULY 24, 2018 233 <br />CORRECT SCRIVENER'S ERROR - ALLEY VACATION — EAST/WEST ALLEY 14' IN <br />WIDTH AND APPROXIMATELY 120' LONG FROM EAST RIGHT-OF-WAY OF <br />EMERSON ST. AND WEST RIGHT-OF-WAY OF NORTH/SOUTH ALLEY BETWEEN <br />NORTHSIDE BLVD. AND HILDRETH ST, <br />On July 9, 2018, the Clerk of the Board was notified that the above alley vacation approved by <br />the Board on December 21, 2017 on behalf of Mr. Murray Miller contained a scrivener's error in <br />the description listing the alley as east right-of-way of the north/south alley, when it should read <br />west right-of-way of the north/south alley. Ms. Bianca Tirado, Deputy City Clerk, requested a <br />correction to the original approval of the Board to correct the Common Council's Ordinance <br />vacating the alley. Ms. Maradik confirmed the corrected description does not affect the location <br />that was reviewed and approved. Therefore, upon a motion by Ms. Maradik, seconded by Ms. <br />Fritzberg and carried, the scrivener's error was corrected to revise the location of the alley as the <br />East/West Alley 14' in Width and Approximately 120' Long from East Right -of -Way of <br />Emerson St. and West Right -of -Way of North/South Alley between Northside Blvd. and Hildreth <br />St. <br />APPROVE/DENY TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Maradik, seconded by Ms. Fritzberg and carried, the following <br />traffic control device requests were approved: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATIONS: 829 S. 271h Street <br />844 S. Lake Street <br />REMARKS: All criteria has been met <br />Upon a motion made by Ms. Maradik, seconded by Ms. Fritzberg and carried, the following <br />traffic control device request was denied: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATION: 2506 W. Huron Street <br />REMARKS: All criteria has not been met <br />Upon a motion made by Ms. Maradik, seconded by Ms. Fritzberg and carried, the following <br />traffic control device request was approved: <br />NEW INSTALLATION: Three (3) Residential Parking by Permit Only and Three (3) <br />No Parking Here to Corner Signs <br />LOCATION: West Side of South Greenlawn Avenue between Hoover <br />Avenue and Wall Street, and Intersections <br />REMARKS: All criteria has been met <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHT TO REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of the following Consent to Annexation and Waiver <br />of Right to Remonstrate. The Consent indicates that in consideration for permission to tap into <br />public water/sanitary sewer system of the City, to provide water/sanitary sewer service to the <br />below referenced property, the applicant waives and releases any and all rights to remonstrate <br />against or oppose any pending or future annexations of the properties by the City of South Bend: <br />A. Rocky Geans, 1125 Quigley Place, South Bend, IN 46617 <br />1. 53098 Summer Breeze Drive — Water/Sewer (Key No.002-1020-045033) <br />Upon a motion by Ms. Maradik, seconded by Ms. Fritzberg and carried, the Consent to <br />Annexation and Waiver of Right to Remonstrate was approved as submitted. <br />RATIFY APPROVAL OF CONTRACTOR, EXCAVATION, AND OCCUPANCY BONDS <br />Ms. Donna Hanson, Division of Engineering, recommended that the following bonds be ratified <br />pursuant to Resolution 100-2000 as follows: <br />Business <br />Bond Type <br />Approved/ <br />Released <br />Effective Date <br />DSN IRA LLC <br />Contractor <br />Approved <br />July 2, 2018 <br />Davrey Properties, LLC <br />Contractor <br />Approved <br />July 16, 2018 <br />Nick Hardrict dba TLK Construction <br />Excavation <br />Approved <br />July 10, 2018 <br />I <br />1 <br />1 <br />
