Resolution No. -Ly -I 1/' U' <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />ACCEPTING THE TRANSFER OF REAL PROPERTY <br />FROM THE CITY OF SOUTH BEND, DEPARTMENT OF REDEVELOPMENT <br />WHEREAS, the City of South Bend, Indiana, Department of <br />Redevelopment (Redevelopment) is the owner of the following <br />described real property situated in St. Joseph County, Indiana: <br />Lot Numbered One Hundred Fifty -seven (157) as <br />shown on the recorded Plat of Wengers & <br />Kriebghbaum Replat of a part of M.L. Wenger's <br />Sixth Addition to the City of South Bend, <br />recorded April 1, 1903 in the Office of the <br />Recorder of St. Joseph County, Indiana, in <br />Plat Book 8, page 103, excepting therefrom a <br />lot or parcel of land two feet (2 ft.) in <br />width East and West taken off of and from the <br />entire length of the West side thereof <br />(hereinafter referred to as the Real <br />Property), <br />rw and; <br />WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend <br />Redevelopment Commission (Commission) is the governing body of the <br />City of South Bend, Department of Redevelopment and, pursuant to <br />I.C. 36 -7 -14 -12.2 may dispose of the'Real Property; and <br />WHEREAS, Redevelopment, through the Commission, is desirous of <br />transferring the Real Property to the City of South Bend, Indiana, <br />with the understanding that the City of South Bend, Indiana, <br />through its Board of Public Works, will subsequently dispose of <br />the Real Property to the Revelation Church of Good in Christ, a <br />non - profit corporation, exempt from income taxation under Section <br />503(c) of the Internal Revenue Code, for use for church purposes; <br />and <br />WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting <br />through the Commission and the City, acting by and through the <br />Board, may exchange or transfer property with one another upon <br />terms and conditions agreed upon by the two (2) entities as <br />evidenced by the adoption of substantially identical resolutions of <br />each entity; and <br />WHEREAS, the South Bend Redevelopment Commission, at its <br />meeting of August 2, 1996 adopted its Resolution No. <br />approving the transfer of the Real Property to the City for $1.00 <br />and upon the terms described hereinabove. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC <br />WORKS FOR THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />
