9632,572 <br />Resolution No. rr <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMISSION <br />APPROVING THE TRANSFER OF REAL PROPERTY <br />TO THE CITY OF SOUTH BEND, INDIANA <br />WHEREAS, <br />ievelopment <br />described real <br />and; <br />the City of South Bend, Indiana, Department of <br />(Redevelopment) is the owner of the following <br />property situated in St. Joseph County, Indiana: <br />35.35' middle part lot G and 35.35' middle part lot F - <br />Rush's 3rd Addition. Commonly known as 605 Bronson <br />Street Key No. 18- 3031 -1184 (hereinafter referred to as <br />the Real Property), <br />WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend <br />Redevelopment Commission (Commission) is the governing body of the <br />City of South Bend, Department of Redevelopment and, pursuant to. <br />I.C. 36 -7 -14 -12.2 may dispose of the Real Property; and <br />WHEREAS, Redevelopment, through the Commission, is desirous of <br />transferring the Real Property to the City of South Bend, Indiana, <br />with the understanding that the City of South Bend, Indiana, <br />through its Board of Public Works, will subsequently dispose of <br />the Real Property to the Housing Development Corporation of St. <br />Joseph County, Inc., a non - profit corporation, exempt from income <br />taxation under Section 503(c) of the Internal Revenue Code, for use <br />for housing purposes; and <br />WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting <br />through the Commission and the City, acting by and through the <br />Board, may exchange or transfer property with one another upon <br />terms and conditions agreed upon by the two (2) entities as <br />evidenced by the adoption of substantially identical resolutions of <br />each entity; and <br />WHEREAS, the Board of Public Works, at its meeting of August <br />19, 1996 will consider its Resolution No. accepting the <br />transfer of the Real Property to the City for $1.00 and upon the <br />terms described hereinabove. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT <br />COMMISSION AS FOLLOWS: <br />1. That the transfer of the Real Property situated in St. <br />Joseph County, Indiana, and generally described as follows: <br />35.35' middle part lot G and 35.35' middle part lot F - <br />Rush's 3rd Addition.
