WHEREAS; the Commission now desires to expand the boundaries of the West Washington -
<br />Chapin Allocation Area No. IA to include the area in Expansion Area No. 2 and this expanded
<br />allocation area, comprising Allocation Area No. I and Expansion Area No. 2, is hereinafter referred
<br />to as the "Allocation Area "; and
<br />WHEREAS, Resolution No. 818 was further amended by Resolution No. 990 adopted on May
<br />10, 1991, and was further amended by Resolution No. 1243 adopted on May 6, 1994, and was further
<br />amended by Resolution No. 1399 adopted on January 2, 1996, and was further amended by Resolution
<br />No. 1436 on July 3, 1996, and said Resolutions No. 990, 1243, 1399 and 1436 modified the list of
<br />parcels to be acquired by adding parcels to the list; and
<br />WHEREAS, Resolution No. 1243 further amended the Development Plan by modifying the
<br />section of the Plan addressing the membership of the West Washington- Chapin Design Review
<br />Committee, and
<br />WHEREAS, it is necessary to modify the list of parcels of property within the Area to be
<br />acquired by adding certain parcels of property described in Exhibit "A" to the Acquisition List; and
<br />WHEREAS, Section 17.5 of the Act provides for the means for amending a resolution or plan in
<br />a way that enlarges the boundaries of a redevelopment area by not more than twenty percent (20%) of
<br />the original redevelopment area or adds one (1) or more parcels to the Acquisition List; and
<br />WHEREAS, the Commission has complied with the notice provisions of Section 17.5 of the
<br />Act; and
<br />WHEREAS, it is necessary to modify the Development Plan to include pages 2a, 4a, 5a, 6a, 7a,
<br />9a, 10a, 11 a, 16g, and 16h; and
<br />WHEREAS, the Development Plan includes a list of parcels of property within the Area to be
<br />acquired; and
<br />WHEREAS, at the hearing held by the Commission on the nineteenth day of February 1999, at
<br />10:00 a.m., Eastern Standard Time, at 1308 County -City Building, South Bend, Indiana, the
<br />Commission heard all persons interested in the proceedings and received and considered _ written
<br />remonstrances and objections and other such evidence presented.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
<br />COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND DEPARTMENT OF
<br />REDEVELOPMENT, AS FOLLOWS:
<br />1. The West Washington- Chapin Development Area is hereby expanded to include Expansion
<br />Area No. 2 as described in the fourth whereas clause above, and the West Washington - Chapin
<br />Development Area, as expanded, is to be known hereafter as the "West Washington- Chapin
<br />Development Area" and is described as follows:
<br />A PARCEL of land being a part of the City of South Bend, Portage Township, St.
<br />Joseph County, Indiana and being more particularly described as follows, viz:
<br />A Parcel of land being a part of Section 10, and a part of Section 11,
<br />Township 37 North, Range 2 East, City of South Bend, Portage
<br />Township, St. Joseph County, Indiana, and being more particularly
<br />described as follows:
<br />COMMENCING at the point of intersection of Western Avenue and
<br />William Street; thence North along the centerline of William Street to the
<br />Easterly projection of the Southerly right -of -way first 14.0 foot alley;
<br />being the point of beginning; thence Westerly along the South right -of-
<br />way line of said 14.0 foot alley and projected to the intersection of the
<br />West right -of -way line of Taylor Street; thence North along the West
<br />right -of -way line of Taylor Street to the intersection of the South right -of-
<br />way line of Wayne Street; thence West along the South right -of -way line
