<br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION EXPANDING THE
<br />BOUNDARIES OF THE AIRPORT ECONOMIC DEVELOPMENT AREA, EXPANDING THE
<br />ALLOCATION AREA FOR PURPOSES OF TAX INCREMENT FINANCING AND AMENDING
<br />THE AIRPORT ECONOMIC DEVELOPMENT AREA DEVELOPMENT PLAN
<br />WHEREAS, the South Bend Redevelopment Commission ( "Commission "), governing
<br />body of the City of South Bend Department of Redevelopment ( "Department "), on February
<br />23, 1990, adopted Resolution No. 919 declaring the Airport Economic Development Area
<br />to be an Economic Development Area within the meaning of I.C. 36 -7 -14 ( "Act "); and
<br />WHEREAS, Resolution No. 919 and the Airport Economic Development Area
<br />Economic Development Plan ( "Development Plan ") adopted by Resolution No. 919 on
<br />February 23, 1990 was confirmed by Resolution No. 938 adopted on June 27, 1990; and
<br />WHEREAS, Resolution No. 919 was amended by Resolution No. 965, adopted on
<br />November 9, 1990 and confirmed by Resolution No. 971 adopted on January 2, 1991 and
<br />said resolutions expanded the Airport Economic Development Area by adding Expansion
<br />Area No. 1 and Expansion Area No. 2; and
<br />WHEREAS, Resolution No. 919 was further amended by Resolution No. 1058,
<br />adopted on May 22, 1992 and said resolution expanded the Airport Economic Development
<br />Area by adding Expansion Area No. 3; and
<br />WHEREAS, Resolution No. 919 was further amended by Resolution No. 1238,
<br />adopted on April 15, 1994; and
<br />WHEREAS, Resolution No. 919 was further amended by Resolution No. 1349,
<br />adopted on July, 7, 1995 and said resolution expanded the Airport Economic Development
<br />Area by adding Expansion Area No. 4; and
<br />WHEREAS Resolution No. 919 was further amended by Resolution No. 1516
<br />adopted on July 18, 1997; and
<br />WHEREAS, Resolution No. 919 was further amended by Resolution No. 1545,
<br />adopted on November 21, 1997 and said resolution expanded the Airport Economic
<br />Development Area by adding Expansion area No. 5, and said resolution redefined the
<br />Airport Economic Development Area as follows
<br />Airport Economic Development Area (AEDA)
<br />A part of Sections 17, 18, 19, 20, 21, 22, 27, 28, 29,30,31, 32 and 33 in Township 38
<br />North, Range 2 East, and Section 4, Township 37 North, Range 2 East all in German
<br />Township, St. Joseph County, Indiana, more particularly described as follows:
<br />Beginning at the intersection of the East right of way line of Bendix Drive and the Northeast
<br />right of way line of Lincolnway West (also known as USR 20); thence Northwesterly along
<br />said Northeast right of way line of Lincolnway West to the East right of way line of
<br />Butternut Road; thence Northwesterly across Butternut Road on a line parallel with and 140
<br />feet Northerly of the survey Line S- USR20 -M (referenced to plans for U.S. 31 Bypass) to
<br />the West right of way line of Butternut Road; thence Northwesterly along the Northeast
<br />limited access right of way line of USR 20 to a point 150 feet to the right of Station
<br />65 +00, Line S- USR20 -IV ?; thence Southwesterly a distance of 300 feet along a line
<br />measured at right angles to said Line S- USR20 -M to a point 150 feet to the left of Station
<br />65 +00 on Line S- USR20 -M; thence Southerly and Southwesterly along the limited access
<br />right of way line of the southeast ramp of the U.S. 31 Bypass to a point being 170 feet to
<br />the right of Station 35 +00 on Line M at the centerline of the U.S. 31 Bypass; thence
<br />Westerly a distance of 320 feet to a point 150 feet to the left of Station 35 +00 on said
<br />Line M; thence Northerly and Northwesterly along the limited access right of way line of
<br />the Southwest ramp of said U.S. 31 Bypass to a point at Station 34 +00 Line S- USR -20 -M
<br />in the limited access right of way line of the Southwest ramp of said U.S. 31 Bypass,
<br />which point is 130 feet Southwesterly measured at right angles from said Line S- USR20 -M;
<br />thence Northeasterly a distance of 250 feet measured at right angles to said Line
<br />S- USR20 -M to a point at Station 34 +00 on Line S- USR20 -M, and being 120 feet measured
