of demonstrating the criminal history of the <br /> applicant, if any. <br /> h. If the application is for a new driver's <br /> license, the applicant must also provide proof <br /> that the applicant is sufficiently proficient in <br /> the English language to communicate with <br /> passengers, law enforcement officials, and <br /> persons processing the prospective driver's <br /> application. The applicant may do so by: (1) <br /> making a statement under oath that the <br /> applicant's native language is English or that <br /> the applicant has spoken English for at least <br /> five (5) years; or (2) producing certified copies <br /> of diplomas or results of an English proficiency <br /> examination. The Controller, Central Services <br /> Division, or a designee accepting the application <br /> shall have the authority to inquire into the <br /> credentials of the organization or entity <br /> providing a diploma or examination results . <br /> (3) The application shall be accompanied by a <br /> photograph of the driver and a current public <br /> passenger chauffeur' s license issued by the State of <br /> Indiana or the State of Michigan, certificate from a <br /> licensed physician certifying that, in the physician' s <br /> opinion, the applicant is not suffering from any <br /> disease or infirmity which may make the applicant an <br /> unsafe or unsatisfactory driver. <br /> (4) Each applicant for a driver's license shall <br /> submit to a drug test at the applicant's expense and <br /> submit the test results with the application. Each <br /> applicant shall also be subject to requests by the <br /> City Controller, Central Services Division, City <br /> Attorney's Office, or designee thereof for drug <br /> testing and shall comply with the request within <br /> forty-eight (48) hours of the request, if a complaint <br /> or investigation demonstrates that drug testing should <br /> be required. Testing shall be conducted by an <br /> independent drug testing entity approved by the <br /> Controller. The Central Services Division shall <br /> maintain a list of the approved testing facilities . <br /> (5) Each applicant must be willing to submit to a <br /> testing program aimed at determining the applicant's <br /> geographical knowledge of the South Bend area.
