<br />A parcel of land being in the South west Quarter of Section 19, Township 38 North,
<br />Range 2 East, German Township, St. Joseph County, Indiana being more particularly
<br />described as follows:
<br />Commencing at the southwest corner of Section 19, Township 38 North, Range 2 East;
<br />thence Northerly 2,855.36 feet to a point, said point being the intersection of the
<br />Westerly line of said section and the centerline of the Indiana East -West Toll Road;
<br />thence Easterly along the centerline of said Toll Road 1,019.36 feet to a point, said
<br />point being the intersection of Olive Road and said Toll Road; thence Southerly along
<br />the centerline of Olive Road 1,416.28 feet; thence Easterly 20 feet to the easterly
<br />right -of -way line of Olive Road and place of beginning; thence Easterly 180 feet to a
<br />point; thence Southerly 120 feet to a point; thence Westerly 180 feet to a point; thence
<br />Northerly 120 feet to the point and place of beginning.
<br />WHEREAS, Section 43 of the Act permits the creation of an allocation area within an
<br />economic development area to provide for the allocation and distribution, as provided by the Act,
<br />of the proceeds of taxes levied on property situated in the allocation area; and
<br />WHEREAS, the Commission in accordance with the Act, has previously established the
<br />Airport Economic Development Area, Allocation Area No. 1 ( "Allocation Area No. V); and
<br />WHEREAS, the Commission, in accordance with the Act, expanded the boundaries of
<br />the Airport Economic Development Area, Allocation Area No. 1 to include Expansion Area No. 1
<br />and Expansion Area No. 2 by the adoption of Resolution No. 965, adopted on November 9,
<br />1990, and confirmed by Resolution No 971, adopted on January 2, 1991 and Expansion Area
<br />No. 3 by the adoption of Resolution No. 1058, adopted on May 22, 1992, and expansion area
<br />No. 4 by the adoption of Resolution No. 1349, adopted on July 7, 1995, and expansion area No.
<br />5 by the adoption of Resolution No. 1545, adopted on November, 21 1997, and expansion areas
<br />No. 6,7 and 8 by the adoption of Resolution No. 1667, adopted on February 19, 1999, and
<br />referred to the Allocation Area, as expanded, as Airport Economic Development Area Allocation
<br />Area No. 1, ( "Airport Economic Development Area Allocation Area No. 11"); and
<br />WHEREAS, the geographic area comprising the Airport Economic Development Area
<br />Allocation Area No. 1 is coextensive with that area comprising the Airport Economic
<br />Development Area (AEDA), as described in the ten whereas clauses above; and
<br />WHEREAS, the Commission now desires to expand the boundaries of the Airport
<br />Economic Development Area Allocation Area No. 1 to include the areas in Expansion Area No. 9
<br />and No. 10 this expanded allocation area, comprising Airport Economic Development Area
<br />Allocation Area No. 1 and Expansion Areas No. 9 and No. 10, is hereinafter referred to as the
