14 Resolution No. 17 8 °Z` A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION APPROVING TRANSFER OF REAL PROPERTY TO THE BOARD OF PARK COMMISSIONERS OF THE PARK DISTRICT OF THE CITY OF SOUTH BEND WHEREAS, the City of South Bend, Indiana, Department of Redevelopment ( "Redevelopment ") has a right, title and interest in a portion of the following described real property situated in the City of South Bend, St. Joseph County, Indiana: Southeast Neighborhood Park, First Replat,Lar KA (Tax Key No. 4-70 -a -06'77 ) (hereinafter referred to as the "Real Property "), and; WHEREAS, pursuant to Ind. Code § 36- 7 -14 -3, the South Bend Redevelopment Commission ( "Commission ") is the governing body of the City of South Bend, Department of Redevelopment and, pursuant to Ind. Code § 36 -7 -14 -12.2, the Commission may dispose of the Real Property; and WHEREAS, pursuant to Ind. Code § 36- 10 -3 -11, the Board of Park Commissioners may acquire the Real Property; and WHEREAS, the Commission desires to transfer its rights, title and interest in the Real Property to the Municipal City of South Bend, Indiana, for the use and benefit of its Board of Park Commissioners of the Park District of the City of South Bend for use by the Board of Park Commissioners in order for the Real Property to be utilized as a public park; and WHEREAS, the Board of Park Commissioners desires to accept transfer of the Real Property from the Commission and agrees to utilize the Real Property as a public park; and WHEREAS, pursuant to Ind. Code § 36- 1 -11 -8, Redevelopment, acting through the Commission and the Municipal City of South Bend, acting by and through the Board of Park Commissioners, may exchange or transfer property with one another upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Board of Park Commissioners, at its meeting o0 ly '21,2003, will consider its Resolution No. A00's— ON , accepting the transfer of the Real Property from the City of South Bend, Department of Redevelopment. that: NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment Commission C1.
