Resolution No. 1810 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />APPROVING THE TRANSFER OF REAL PROPERTY <br />TO THE CITY OF SOUTH BEND, INDIANA AND RATIFYING, CONFIRMING AND <br />APPROVING CERTAIN ACTIONS RELATED TO THE TRANSFER <br />WHEREAS, the City of South Bend, Indiana, Indiana, Department of Redevelopment <br />( "Redevelopment ") is the owner of the real property and improvements situated in the City of South <br />Bend, St. Joseph County, Indiana ( "Property ") and being more particularly described as follows: <br />Lot lettered "A" as shown on the recorded Plat of Leighton Plaza Re -plat of the City <br />of South Bend Original Plat recorded June 15, 1999 as Document Number 9927350 <br />in the Office of the recorder of St. Joseph County, Indiana. <br />WHEREAS, pursuant to I.C. 36- 7 -14 -3, the South Bend Redevelopment Commission <br />( "Commission ") is the governing body of the City of South Bend, Department of Redevelopment <br />and, pursuant to I.C. 36 -7 -14 -12.2 and 36- 1 -11 -8, may dispose of the Property; and <br />WHEREAS, pursuant to I.C. 36- 9 -6 -3, the Board of Public Works of the City of South Bend <br />(the "Board ") has custody of and may maintain all real property of the City of South Bend; and <br />WHEREAS, the Commission is desirous of transferring the Property to the City of South <br />Bend ( "City "); and <br />WHEREAS, pursuant to I.C. 36- 1 -11 -8, Redevelopment, acting through the Commission, <br />and the City, acting by and through its Board of Public Works, may exchange or transfer property <br />with one another upon terms and conditions agreed upon by the two (2) entities as evidenced by the <br />adoption of substantially identical resolutions of each entity, and <br />WHEREAS, the Board of Public Works of the City of South Bend, Indiana, at its meeting <br />of November 27, 2000 will consider its Resolution No. 119 -2000 accepting the transfer of the <br />Property from the City of South Bend, Indiana Department of Redevelopment; and <br />WHEREAS, in order to facilitate the transfer and subsequent disposition of the Property by <br />the City, Jon R. Hunt, the Executive Director, Department Community and Economic Development <br />has heretofore executed a quit claim deed on behalf of the Commission conveying all of the right, <br />title and interest in the Property to the City of South Bend; <br />WHEREAS, the Commission desires to ratify, confirm and approve the transfer of the <br />Property to the City and to ratify, confirm and approve the quit claim deed signed by Jon R. Hunt; <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT <br />COMMISSION THAT: <br />The transfer of the Property by the City of South Bend, Department of <br />
