South Bend Redevelopment Commission <br />Regular Meeting— August 3, 2001 <br />6. NEW BUSINESS (CONT.) <br />i. continued... <br />Commission accept the proposal from Danch <br />Hamer & Associates, Inc. <br />Upon a motion by Mr. Caldwell, seconded by <br />Mr. Kahn and unanimously carried, the <br />Commission approved the proposal from Danch <br />Hamer & Associates for professional services in <br />the South Bend Central Development Area. <br />a. Commission approval requested for <br />Professional Agreement for legal services in <br />the Sample -Ewing Development Area. <br />(Zevnik Horton) <br />Mrs. Kolata explained that the Commission <br />approved the proposal from Zevnik Horton at its <br />May 4, 2001 meeting. Zevnik Horton will <br />attempt to recover money for the Commission <br />from the insurance policies of companies which <br />were responsible for environmental hazards left <br />behind in the development area. This document <br />is the contractual agreement for those services. <br />Ms. Greene stated that Zevnik Horton will be <br />providing legal services on a contingency basis, <br />plus expenses. We've structured the agreement <br />so that they receive a contingency based on the <br />amount of funds recovered. In addition, the <br />Commission has retained the right to oversee the <br />litigation. The agreement sets a $15,000 cap on <br />expenses per 6 -month period. ($30,000 annually) <br />The agreement states that the Commission <br />reserves the right to limit the duration of this <br />payment arrangement by providing Zevnik <br />Horton with thirty days written notice of the <br />-5- <br />COMMISSION APPROVED THE PROPOSAL FROM <br />DANCH HARNER & ASSOCIATES FOR <br />PROFESSIONAL SERVICES IN THE SOUTH BEND <br />CENTRAL DEVELOPMENT AREA. <br />
