South Bend Redevelopment Commission Regular Meeting —June 20, 2003 recommends the Commission approve and sign the Disclosure Statement. The statement records there is zero (0) costs to the Commission to complete the transfer of the real estate. Signature of the Disclosure Statement is necessary to complete the transfer and further the implementation of the development plan for the South Bend Central Development Area. Upon a motion by Mr. Faccenda, seconded by Mr. Kahn and unanimously carried, the Commission approved the execution of the Disclosure Statement for the transfer of property from the South Bend Redevelopment Authority to the South Bend Redevelopment Commission. (Chocolate Cafe) (9) Commission approval requested for Grant of Non - Buildable Perpetual Easement. (Chocolate Cafe) Mr. Mathia continued his presentation with an explanation of the third document related to the transfer of real property from the South Bend Redevelopment Authority. That document is a Grant of Non - Buildable Perpetual Easement. " The document is required to redraw the existing Non - Buildable Easement to take into consideration the proposed addition to the Chocolate Cafe. The Redevelopment Authority on June 18, 2003 approved a Release of Easement for the original Grant of Non - Buildable Perpetual Easement which was signed by the Authority on July 13, 1998. The new easement is required by the Building Department in order to obtain a building permit for the planned addition. Specifically, a permit for the placement of 12 COMMISSION APPROVED THE EXECUTION OF THE DISCLOSURE STATEMENT FOR THE TRANSFER OF PROPERTY FROM THE SOUTH BEND REDEVELOPMENT AUTHORITY TO THE SOUTH BEND REDEVELOPMENT COMMISSION.
