5. OLD BUSINESS <br />A. continued... <br />and 217 South Main Street. The request was <br />tabled because of concern that the proposed date <br />may interfere with a special event to be <br />presented by Downtown South Bend, Inc. the <br />following day. Subsequently, staff contacted the <br />Center For The Homeless and Downtown South <br />Bend. As a result of discussions, the Center <br />agreed to promote the DTSB December 5 tree <br />lighting ceremony at its holiday luncheon to be <br />held on December 4. The Center will also <br />promote Downtown South Bend through its <br />Christmas televison special. DTSB confirmed <br />they had no objections to the Center's event <br />being held on December 4. <br />In addition, the Center also requested <br />permission to erect a small scaffolding on the <br />southwest corner of the property to house <br />projection equipment that will shine a star on <br />' the Holladay Corporation Building from <br />December 4, 2003 through December 24, 2003. <br />The projection equipment would occupy the site <br />through December 29, 2003. Staff recommends <br />approval of the request subject to receiving an <br />Indemnification and Hold Harmless Agreement <br />from the Center that is acceptable to legal <br />counsel. <br />Upon a motion by Mr. Kahn, seconded by <br />Ms. Jones and unanimously carried, the <br />Commission authorized a request to use <br />Commission owned property located at 215 and <br />217 South Main Street in the South Bend <br />Central Development Area from December 4 <br />through December 29, 2003 subject to receipt of <br />an Indemnification Agreement acceptable to <br />legal counsel.
