. REGULAR MEETING ti~7 JULY 23, 2007 WHEREAS, pursuant to Ind. Code ' 36-1-11-8, the Department, by and through the Commission and the City, by and through the Board, may exchange or transfer property with one another upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the Commission has or will consider a substantially similar resolution approving the transfer of the Real Property to the Board; NOW, THEREFORE, BE IT RESOLVED by the City of South Bend, Indiana, Board of Public Works that: 1. The transfer of the Real Property situated in St. Joseph County, Indiana, and more particularly described at Exhibit A for the sum of One and 00/100 Dollar ($1.00), by the City of South Bend, Indiana, Department of Redevelopment to the City of South Bend, Indiana shall be, and hereby is, approved. 2. The Board hereby approves the form of a quit-claim deed attached hereto as Exhibit B and the President and/or any other member is authorized to execute the deed and any other instrument necessary to accept all of the right, title and interest in the Real Property on behalf of the City and to complete the transfer. 3. This Resolution shall be in full force and effect upon its adoption by the Board and upon the adoption of a substantially similar resolution of the Commission. The transfer of the real estate shall not be effective until a deed is duly recorded effecting the same. ADOPTED at a meeting of the Board of Public Works of the City of South Bend, Indiana held on July 23, 2007, at 1308 County-City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
