Preel <br />for 1633 Knoblock) <br />(3) Commission approval requested for <br />Confidential Settlement with as insurance <br />carrier of the White Farm Equipment <br />Company. <br />Mr. Leone noted that the confidentiality of <br />this agreement relates to the specific terms of <br />the agreement. ent. Staff may comment on the <br />issues that gave rise to this particular dispute. <br />It is the subject of environmental litigation <br />which has been filed by special counsel, <br />Ple vs Shadley, in Indianapolis courts. <br />Mr. 'Laurent explained that the confidential <br />settlement is related to the city and <br />Commission's claim for past environmental <br />damages at the site of the former Oliver <br />Chilled Plow Works. That suit was filed <br />against previous owners of the site, White <br />Pam Equipment Company and the Oliver <br />company. This settlement is related to a <br />similar effort with the Studebaker properties <br />of environmental cost recovery. There were <br />environmental policies that these companies <br />had, gcneral comprehensive liability policies <br />that for a time inclidcd environmental <br />damages that occurred while the companies <br />owned the property and while these <br />insurance policies were in place.
