�2,� Users desirin� to dispute such fines must file a written request for the <br /> Director to reconsider the fine alon� with full pavment of the fine amount <br /> within ten (10) days of bein� notified of the fine. Where a reQUest has <br /> merit the Director may convene a hearin� on the matter. In the event the <br /> User's appeal is successful the �avment shall be returned to the User. The <br /> Director mav add the costs of preparin� administrative enforcement <br /> actions such as notices and orders, to the fine. <br /> � Issuance of an administrative fine shall not be a bar a�ainst, or a <br /> prerequisite for taking any other action a�ainst the User. <br /> � Director Reconsideration and User Administrative Appeals <br /> � Actions Subject to Director Reconsideration and/or Board of Works <br /> Appeal Any User aggrieved by a final action dele�ated to the Director <br /> under: <br /> � Section 17-10(a)(2) requirin� a User to restrict the volume <br /> or point of dischar�e; <br /> � Section 17-10(a)(3) requirin� a User to install a storage or <br /> flow-control facilitv; <br /> � Section 17-10(a)(2) den in a permit transfer; or <br /> � Section 17-10(n)(4) revoking a permit. <br /> �) This Section 17-11 subsection (a), issuin� any authorized <br /> Administrative Enforcement Remedv. <br /> ma�quest reconsideration by the Director within fifteen (15) <br /> davs of such Director action and the Director shall have thirt�30) <br /> davs from receipt of request to make a decision related to <br /> reconsideration. If the Director fails to act within thirt�(30) days <br /> from receipt of the request, or if the Director's reconsideration <br /> decision is unsatisfactory to the User requesting reconsideration, <br /> the User mav appeal such decision to the Board of Public Works <br /> upon submission of a written petition for review filed with the <br /> Board of Public Works within seven (7) days after_notification of <br /> the Director's decision, or if the Director fails to act, then the <br /> written Qetition for review shall be filed with the Board of Public <br /> Works thirty-five (35�ys the date of request for Director <br /> reconsideration. <br /> 73 <br />
