Parks, Recreation, Cultural Arts & Entertainment Committee (PARC} <br />2005 South Bend Common Council <br />The July 24, 2006 meeting of the Parks, Recreation, Cultural Arts & <br />Entertainment Committee {PARC) Committee of the South Bend Common <br />Council was called to order by its Chairperson, Council Member Derek Dieter, at <br />4:49 p.m, in the Council's Informal Meeting Room. <br />Persons in attendance included Council Members Pfeifer, Varner, Kuspa, Kirsits, <br />Rouse, Dieter, Kelly, and Puzzello; Community and Economic Development <br />Executive Director Sharon Kendall, Martha Lewis, Assistant City Attorney <br />Thomas L. Bodnar, City Clerk John Voorde, Mrs. Kopola, Don Inks, Marty <br />Wolfson, Cahrles A. Shock, Park Superintendent Phil St. Clair, Jamie Loo of the <br />Saufh Bend Tribune, and Kathleen Cekanski-Farrand, Council Attorney. <br />Council Member Dieter noted that members of the PARC Committee included <br />Council Members Kuspa, Puzzello, Kirsits and himself; and Charles A. Shock <br />serves as the Citizen Member. <br />Substitute Bill No. 27-06: Park Rules: <br />Council Member Dieter called for a presentation on Substitute Bill No. 27-06 <br />which would amend the South Bend Municipa! Code by including a new Section <br />19-79 Park and Park Program Rules. <br />Assistant City Attorney Thomas L. Bodnar made the formal presentation. He <br />noted that Section 2-137' of the South Bend Municipal Code authorized the Park <br />Department to operate under the state law located at Indiana Code § 36-10-4- <br />9(c). He noted that the state law provides the Park Board with authority to set <br />rules, however an Indiana case has raised doubt. In light of that, the proposed <br />ordinance has been drafted. <br />Mr. Bodnar noted that in light of various concerns which were raised with regard <br />to the original version, a meeting was held with Park Superintendent Phil St. <br />Clair, Council Member Dieter, the Council Attorney and himself. <br />Mr. Bodnar stated that additional information, requested by the Council Attorney, <br />has been submitted (copy attached), in response to her June 6~~' memorandum <br />(copy attached) and the subsequent discussions. <br />The substitute bill addresses all concerns previously raised and is recommended <br />for passage. Mr. Bodnar noted that the regulations would provide a mechanism <br />which would protect patrons of the parks, as well as the park staff. He noted that <br />the permanent ban provision has been eliminated and knowledge of park rules <br />
